<br />conditioning project approval on an appellant neighbor's approval offence design raises issues <br />with delegating the City's authority to a private party. <br />CONCLUSION <br />The applicants' addition is well designed and would result in an attractive home that is <br />appropriate for the subject property and that is compatible with the surrounding residences. The <br />project meets all required setbacks, height and open space requirements, and is well within the <br />floor area ratio. The Planning Commission agreed with the Zoning Administrator's approval of <br />the addition, but added two conditions with which the Diaz' disagreed. Staff believes that the <br />condition of approval requiring replacement of three trees is a reasonable mitigation measure <br />and should be retained, but does not support the condition that the Diaz' replace the entire <br />shared common property line fence. <br />FISCAL IMPACT <br />This project will have minimal fiscal impact on the City of Pleasant on. <br />STAFF RECOMMENDATION: <br />Staff recommends that the City Council: <br />1. Approve a portion of the appeal by deleting the condition added by the Planning <br />Commission requiring the applicants to construct and pay for a seven-foot tall side <br />property line fence; <br />2. Deny a portion of the appeal by upholding the condition added by the Planning <br />Commission requiring the applicants to replace the three trees to be removed; and <br />3.
