<br /> construct and pay for a seven-foot fence at the north side <br /> property line between the Diaz' and the Croftons (original <br /> appellants) for the length of the entire yard, the design of <br /> which shall be subject to the review and approval of the <br /> Planning Director and the design and installation approved by <br /> the Croftons. <br />STAFF RECOMMENDATION: <br />Staff recommends that the City Council: <br />1. Approve a portion ofthe appeal by deleting the condition added by the Planning <br />Commission requiring the applicants to construct and pay for a seven-foot tall side <br />property line fence; <br />2. Deny a portion of the appeal by upholding the condition added by the Planning <br />Commission requiring the applicants to replace the three trees to be removed; and <br />3. Adopt the attached draft resolution approving Case PADR-1271, subject to the modified <br />conditions listed in Exhibit "B." <br />SUMMARY <br />At issue is whether two conditions added by the Planning Commission to the approval of the <br />application to construct an approximately 385-square-foot first-story addition and a 221-square- <br />foot second-story addition to the east side of an existing residence located at 4769 Peaceful Lane <br />should be upheld. After a contentious public hearing where a neighbor expressed concern over <br />privacy issues, the Planning Commission denied the appeal, thereby approving the addition (4- <br />0-2 vote) with amended conditions of approval. The applicant has appealed the conditions added <br />by the Commission. Staff believes the added condition requiring replacement of trees would <br />mitigate privacy concerns of the neighbor/original appellant, but that the added condition <br />requiring the applicant to pay for the installation of a common side property line fence does not <br />have a direct relationship to the project's impacts and should, therefore, be deleted. <br />Honorable Mayor and Members of the City Council: <br />BACKGROUND <br />Bob and Joyce Diaz, the owners and residents of 4769 Peaceful Lane, applied for administrative <br />design approval (PADR-1271) to construct an approximately 385-square-foot first-floor addition <br />and a 221-square-foot second-floor addition to the east side ofthe existing home. Greg Crofton, <br />a concerned neighbor, requested a Zoning Administrator hearing that was held on May 20th, <br />2005.
