<br /> Resolution No. 05-075 <br /> Page 3 <br /> (or if the term of the TVTBID is less than five years) and there are funds <br /> remaining at the end of the term, such funds may be used for purposes <br /> consistent with the requirements of this Resolution. <br /> Section 10. The Cities of Livermore, Dublin, and San Ramon shall transmit their <br /> collected assessments to the City of Pleasanton who shall administer the <br /> funds collected. <br /> Section 11. No bonds will be issued for the TVTBID. <br /> Section 12. The time and place for the public hearing to establish the TVTBID and the <br /> levy of the assessments is set for December 6,2005 at 7:00 p.m. at the City <br /> of Pleasanton, City Council Chambers, 200 Old Bernal Avenue, <br /> Pleasanton, California. The Pleasanton City Clerk is to provide written <br /> notice to the lodging businesses of the date and time of the public hearing. <br /> Section 13. At the public hearing the testimony of all interested persons for or against <br /> the establishment of the District, the boundaries of the District, or the <br /> furnishing of specified types of improvements or activities will be heard. <br /> Section 14. A protest against the establishment of the TVTBID, the boundaries of the <br /> TVTBID, and the furnishing of a specified type of improvement or activity, <br /> as provided in Section 36623, may be made in writing. To count in the <br /> majority protest against the TVTBID, a protest must be in writing. A <br /> written protest may be withdrawn in writing at any time before the <br /> conclusion of the public hearing. Each written protest shall contain a <br /> written description of the lodging business in which the person signing the <br /> protest is interested, sufficient to identify the lodging business and its <br /> address. If the person signing the protest is not shown on the official <br /> records of the city in which the lodging business is located as the owner of <br /> the lodging business, then the protest shall contain or be accompanied by <br /> written evidence that the person is the owner of the lodging business. If the <br /> owner of the lodging business is a corporation, LLC, partnership or other <br /> legal entity, the authorized representative for the entity shall be authorized <br /> to sign the protest. Any written protest as to the regularity or evidence of <br /> the proceedings shall be in writing and clearly state the irregularity or <br /> defect to which objection is made. Written protests must be received by the <br /> City Clerk of the City of Pleasanton before the close of the hearing <br /> scheduled herein and may be delivered or mailed to the City Clerk, City of <br /> Pleasanton, 123 Main Street, PO Box 520, Pleasanton, California, 94566. <br /> Section 15. If at the conclusion of the public hearing, there are of record, written <br /> protests by the owners of the lodging businesses within the proposed <br /> TVTBID that will pay fifty percent (50%) or more of the estimated total <br /> assessments of the entire TVTBID, no further proceedings to establish the <br />
