<br /> / ...... <br /> 46 <br />- <br />pLEASANTONo City Council <br /> Staff Report <br /> October 18, 2005 <br /> Law Department <br />SUBJECT: AMENDMENT TO THE LITTER ORDINANCE TO PROHIBIT THE <br /> UNAUTHORIZED USE OF ENCLOSED PUBLIC RECEPTACLES <br /> AND PRIVATE RECEPTACLES <br />STAFF RECOMMENDATION: <br /> Introduce the attached Ordinance. <br />SUMMARY: The City's existing Litter Ordinance does not expressly prohibit a person <br /> from putting his/her refuse into a large waste receptacle on public property <br /> or into a waste receptacle (of any size) on another's property. From time to <br /> time, City staff receives complaints that a person has, without permission, <br /> placed refuse into another person's waste receptacle. This also happens <br /> from time to time with the large waste receptacles that are on City and other <br /> public property. The attached Ordinance would prohibit that activity. <br />Honorable Mayor and Members of the City Council: <br />BACKGROUND <br />The City's ordinance concerning litter is codified in Chapter 9.08 of the Municipal Code. Litter <br />is defined therein to mean "garbage, refuse and rubbish" as defined in the ordinance, and "all <br />other waste materials." "Garbage" is defined as wastes from food preparation; "refuse" is solid <br />waste, dead animals, etc.; and "rubbish" is both combustible and noncombustible wastes, such as <br />paper, cigarettes (presumably cigarette butts!), yard clippings, leaves and the like. The <br />Ordinance prohibits a number of litter related activities: can't throw or deposit litter on the <br />street; no sweeping of litter into the street; no throwing of litter from vehicles; no throwing or <br />depositing handbills on any street; no handbills on vehicles, etc. <br />SR:05:282 <br />Page 1 of2 <br />
