CITY OF PLEASANTON AGREEMENT FOR CONSULTANT SERVICES THIS AGREEMENT is made and entered into this _ day of ,2005, by and between the CITY OF PLEASANTON, a municipal corporation (hereinafter referred to as the "City"), and M.D. Fotheringham, Landscape Architects, a Califomia Corporation, whose address is 323 Geary Street, San Francisco, Califomia, 94102, and telephone number is (415) 434-8292 (hereinafter referred to as the "Consultant"). WITNE SSETH: A. Consultant is qualified to provide, and experienced in providing professional landscape design consulting services and has offered its services for the purposes specified in this Agreement B. In the judgment of the City, it is necessary and advisable to employ the services of Consultant for the purposes provided herein. NOW, THEREFORE, in consideration of the mutual covenants, agreements, and conditions contained herein, City and Consultant agree as follows: 1. Consultant's Sl'rvi..l's. Consultant shall diligently perform the services and furnish the materials, reports, drawings, and related materials described in Exhibit "A," Scope of Work, attached hereto and incorporated herein by this reference. 2. City Servil"p.~. In order to assist Consultant in this work, City shall provide, if necessary, any existing plans of the area on file, necessary direction, and report review within a reasonable time. 3. Staff. The Project Manager for Consultant shall be Michael Fotheringham. Consultant shall not replace Mr. Fotheringham without prior approval of the City. 4. Suffidl'nl:}' of Consultant's Work All reports, drawings, plans, and specifications prepared for City shall be adequate and sufficient to meet the purposes for which they are prepared. 5. Owner~hip of Work All reports, drawings, plans and specifications, maps, designs, work data, and all other documents completed or partially completed by Consultant in the performance of this Agreement shall become the property of the City.
