Only modular newspaper dispensers accommodating more than one (1) newspaper shall be allowed outside of buildings within the development. The design of these dispensers shall be approved by the Planning Director. Dispensers within the public right-of-way shall require an encroachtnent permit by the Engineering Department. Landscaping and Irrigation System Design and Operation: 29. The project developer shall enter into an agrccmcut with the City, approved by the City Attorney, which guarantees that all landscaping and open space areas included in this project will be maintained at all times in a manner consistent with the approved landscape plan for this development. Said agreement shall run with the land for the duration of the existence of the structures located on the subject property. 30. The proposed liquidamber species shall be replaced with a visually equivalent tree. This change shall be shown on the revised landscape plan submitted to the Planning Director fbr review and approval before issuas~ce of a building permit. 31. All ncw trccs shall be V,venty-four-inch (24") box size specimens. This change shall bc shown on the final building permit plan set submitted for review and approval to the Planning Director before issuance of a building permit. 32. A final landscape plan and irrigation plan shall be subinittcd to and approved by Planning Director as part of the building permit plan set priur to issuance of an on-site permit. Said landscape plan shall be consistent with the approved landscape plan plus any condi- tions of approval, and shall be detailed in terms of species, location, size, quantities, and spacing. 33. All shrubs used in landscaping be a minimum size of five (5) gallons, unless otherwise shown on the approved landscape plan. 34. Six inch (6") vertical concrete curbs or railroad ties shall be installed between all paved and landscaped areas. 35. The project developer shall provide root control barriers and four inch (4") perforated pipes for parking lot trees, street trees, and trees in planting areas less than ten fcct (10' 0") in width, as dctcrmined necessary by the Planning Director at the time of review of the final landscape plans.
