The <br /> Pleasanton City Clerk is to provide written notice to the lodging businesses of the date <br /> and time of the public hearing. <br /> Section 13. At the public hearing the testimony of all interested persons for or <br /> against the establishment of the District, the boundaries of the District, or the furnishing <br /> of specified types of improvements or activities will be heard. <br /> Section 14. A protest against the establishment of the TVTBID, the boundaries <br /> of the TVTBID, and the furnishing of a specified type of improvement or activity, as <br /> provided in Section 36623, may be made in writing. To count in the majority protest <br /> against the TVTBID, a protest must be in writing. A written protest may be withdrawn in <br /> writing at any time before the conclusion of the public hearing. Each written protest shall <br /> contain a written description of the lodging business in which the person signing the <br /> protest is interested, sufficient to identify the lodging business and its address. If the <br /> person signing the protest is not shown on the official records of the city in which the <br /> lodging business is located as the owner of the lodging business, then the protest shall <br /> contain or be accompanied by written evidence that the person is the owner of the <br /> lodging business. If the owner of the lodging business is a corporation, LLC, partnership <br /> or other legal entity, the authorized representative for the entity shall be authorized to <br /> sign the protest. Any written protest as to the regularity or evidence of the proceedings <br /> shall be in writing and clearly state the irregularity or defect to which objection is made. <br /> Written protests must be received by the City Clerk of the City of Pleasanton before the <br /> close of the hearing scheduled herein and may be delivered or mailed to the City Clerk, <br /> City of Pleasant on, 123 Main Street, PO Box 520, Pleasanton, Califomia, 94566. <br /> Section 15. If at the conclusion of the public hearing, there are of record, <br /> written protests by the owners of the lodging businesses within the proposed TVTBID <br /> that will pay fifty percent (50%) or more of the estimated total assessments of the entire <br /> TVTBID, no further proceedings to establish the TVTBID shall occur. If the majority of <br /> written protests is only as to an improvement or activity proposed, then that type of <br /> improvement or activity shall not be included in the District Management Plan. <br /> Section 16.
