Doul!las and Patricia Sutton <br />Application for conditional use permit approval to expand an existing small family daycare <br />facility for up to eight children located at 5574 Paseo Navarro into a large family daycare <br />facility of up to 14 children. Zoning for the property is R-I-6,500 (Single-Family <br />Residential) District. <br />Ms, Decker summarized the staff report and described the application process for use permits for <br />large family daycare facilities, She noted that under ordinary circumstances, projects ofthis <br />nature would have been processed at the Zoning Administrator (ZA) level but that this project <br />had not been heard by the Zoning Administrator. She described how the State Code allowed this <br />use as a single-family residence with standards related to spacing, traffic, parking, noise, and the <br />Fire Code. State law permits up to 12 children, and an increase to up to 14 children may be <br />allowed if certain State standards as to the number of children and age ratios were held. The <br />City's use permit would also be for up to 14 children; a seven-day noticing period was required <br />to start the Zoning Administrator hearing process. Ms. Decker stated that the project had been <br />elevated to the Planning Commission to expedite the process. She noted that Commissioner Fox <br />had requested staff to look at the conditions related to the State standards and how other large <br />family daycare facilities in the City had been considered. She noted that very few had gone to a <br />ZA hearing; consequently, there were data for very few applications because staff reports were <br />not generated at levels lower than a ZA hearing. <br />She noted that this particular site seemed to meet the issues considered for large family day care <br />and displayed the layout and scope of this project. She noted that the staff report contained <br />detailed responses to how the application meets the standards; there were no other large-family <br />daycare facilities within 300 feet and that this street has a traffic level-of-service (LOS) A, which <br />is not changed by this proposed application, The parking requirements consist of two parking <br />spaces within the garage, two outside the garage in the driveway area, and two near the garage. <br />She noted that this application was noticed within 1,000 feet of the site, and public comments <br />expressed concerns related to traffic, parking, safety, noise, aesthetics, and decreased property <br />values. She noted that while there may be some increased traffic, the LOS would not change; <br />there would be sufficient space for pick-up and drop-off, The noise limits of 65 dBA would not <br />be exceeded. <br />Ms, Decker noted that the hours of operation were typical of the use and recommended approval <br />of this application, <br />In response to an inquiry by Commissioner Blank regarding the "respect neighbors" flier, <br />Ms, Decker replied that it was important to communicate with the customers of the daycare <br />facility certain practices, such as blowing the car horn, that would not be considerate of the <br />neighbors. <br />In response to an inquiry by Chairperson Maas regarding the number of children, Ms. Decker <br />replied that there may not be 14 of the same age group. <br />Ms, Nerland advised that the ratio was governed by the State, e.g., no more than three infants at <br />the same time that 12 children are being cared for.
