0) <br /> <br />(k) <br /> <br />(m) <br /> <br />(n) <br /> <br />(o) <br /> <br />(q) <br /> <br />(r) <br /> <br />(s) <br /> <br />Improvement Agreement: "Improvement Agreement" shall mean the agreement <br />for implementation of public improvement(s) identified in the Improvement Plan <br />as set forth in the Subdivision Map Act, California Government Code § ~ 66410 <br />et seq. Depending upon the timeframe for implementation of certain public <br />improvements, as provided within these Conditions, certain public improvements <br />may not be necessitated within the Iimefrsmes provided under the Subdivision <br />Map Act, and "Deferred Improvement Agreements" may be necessitated. <br /> <br />Improvement Plan: "Improvement Plan" shall mean the plan for public <br />improvement(s) as set forth in the Subdivision Map Act, California Government <br />Code $ § 66410 et seq. <br /> <br />Initial Project Approvals: [See Development Agreement]. <br /> <br />Master Vesting Tentative Map: The "Master Vesting Tentative Map" (MVTM) <br />shall be the MVTM for the Property. The MVTM shall be prepared al~er Initial <br />Project Approvals have been approved. <br /> <br />Parcel Developer: A "Parcel Developer" shall mean the entity responsible for <br />actual development of one or more Parcels, or portions thereof, created under <br />MVTM or any subsequent subdivision of such Parcels. <br /> <br />Plan Area: Tile "Plan Area" shall refer to the entirety of the land area that is the <br />subject of the Specific Plan, the Bemal Property PUD, the MVTM, and the <br />Development Agreement. <br /> <br />Planning Director and Planning Deparanent: The "Planning Director" and <br />"Plmming Department" or "planning" shall mean the Planning Director of the <br />Pleasanton Planning Department or the Pleasanton Planning Department, <br />respectively. <br /> <br />Project: Unless otherwise specified, "Project" or "the Project" shall refer to <br />development resulting from and that is tt~e subject of Phase 1 of the Specific Plan <br />for the Bernal Property, the Bernal Property PUD, the MVTM, and the <br />Development Agreement. <br /> <br />Property: Unless otherwise specified, "Property" or "the Property" shall refer to <br />the entirety of the land area that is the subject of the Specific Plan for the Bernal <br />Property, the Bernal Property PUD, the MVTM, and the Development <br />Agreement. <br /> <br />Property Owner: The "Property Owner" shall mean OHC Bernal Investors, LLC, <br />and shall also mean the successors and assigns ofGHC Bernal Investors, LCL's <br />interests in the Project, provided that the rights and obligations of those successors <br /> <br />Conditions of Approval Page 2 of 49 Revised August 21, 2000 <br /> <br /> <br />
