18.106.020 Conditional use permit requirements. <br /> <br /> A conditional use permit shall be required for every second unit. All of the <br />requirements of Chapter 18.124 shall apply hereto, except that the Zoning Administrator <br />shall hold the public hearing and make the required findings, as provided in Sections <br />18.124,060 and 18.124.070 of the Municipal Code, unless the Zoning Administrator <br />determines in his or her sole discretion to refer the matter to the Planning Commission. <br /> <br /> Decisions of the Zoning Administrator may be appealed to the Planning <br />Commission, and decisions of the Planning Commission may be appealed to the City <br />Council as provided in Sections 18.124.090 of the Municipal Code. All public hearings <br />regarding second units shall be publicly noticed as described in Section 18.124,040. <br /> <br />18.106.030 Conflicting regulations. <br /> <br />A, When the site development regulations of this Chapter conflict with specific <br /> regulations for second units (not simply regulations for general Class I <br /> accessory structures) in a planned unit development or specific plan, the <br /> planned unit development and specific plan shall control. <br /> <br />B. A second unit is not considered to increase the density of the lot upon which it <br /> is located. <br /> <br />18.106.040 Attached second units--Permitted districts, height limitations, setbacks, <br /> open space, and other regulations. <br /> <br /> Attached second units shall be permitted on all one-family and multi-family <br />residential lots, including one-family and multi-family residential lots in planned unit <br />developments, upon the granting of a conditional use permit. <br /> <br />Attached second units shall be subject to the maximum height, and the <br />minimum front, rear, and side yard requirements of the main structure. <br /> <br />Attached second units in a multi-family residential zoning district shall <br />meet the open space requirement as required for apartments with the same <br />number of bedrooms in the applicable zoning district(s). <br /> <br />Ca <br /> <br />Except as modified by this Chapter, all other regulations embodied in the <br />zoning of the property for main dwellings shall apply to the development of <br />attached second units. <br /> <br />Page 2 <br /> <br /> <br />
