Exhibit "B" <br /> Final Conditions of Approval for PUD-99-07 <br /> <br /> TTK Partnership <br /> <br /> October 20, 1999 <br /> <br />1. Development shall be substantially as shown on the "Alternative Plan Two" devel- <br /> opment plan, Exhibit "A", dated "Received July 9, 1999" on file with the Planning <br /> Department, except as modified by the following conditions. Minor changes to the <br /> plans may be allowed subject to the approval of the Planning Director if found to <br /> be in substantial conformance to the approved exhibits. <br /> <br />2. If for any reason the PUD development plan for the municipal golf course fails, <br /> then this PUD development plan shall expire. The project developer would be re- <br /> quired to submit a new PUD development application for the subject property with <br /> a maximum density of ten dwelling units. All issues pertaining to the extension of <br /> public infrastructure to this site needed to support its density including, but not <br /> limited to, the extension and improvement of public streets, the extension of water, <br /> storm, and sanitary sewer lines and lift stations, undergrounding overhead lines, <br /> etc., would be the responsibility of the project developer. <br /> <br />3. This PUD Development Plan shall lapse in the event that the Happy Valley an- <br /> nexation (Annexation No. 144) scheduled for vote approval in November, 1999 is <br /> rejected. <br /> <br />4. This PUD shall be subject to the permitted and conditional uses of the PUD-SRDR <br /> zone stated in the Happy Valley Specific Plan. <br /> <br />5. The project developer shall pay any and all fees to which the property may be sub- <br /> ject prior to issuance of building permits. The type and amount of the fees shall be <br /> those in effect at the time the building permit is issued. <br /> <br />6. The project developer shall fund this development's pro-rata share of the infra- <br /> structure improvement costs specified in the Happy Valley Specific Plan and the <br /> City's adopted sewer/water policies for the Happy Valley area. All water/sewer <br /> main extensions shall be at the full cost of the project developer; however, the pro- <br /> ject developer may be entitled to reimbursement in the event this cost exceeds its <br /> share as established in the above-listed programs.
