,%%~,,,,.~ CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1798 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> SUMMERHILL HOMES (NOLAN FARMS) FOR PUD <br /> DEVELOPMENT PLAN APPROVAL, AS FILED UNDER <br /> CASE PUD-99-05 <br /> <br />WHEREAS, SummerHill Homes has applied for PUD development plan approval to allow the <br /> subdivision of a 15.2+ acre site (two existing parcels) into 31 lots ranging in size <br /> from approximately 11,387 square feet to 7,787 square feet, with an approximately <br /> 1.8-acre remainder site with two existing homes located at 1015, 1027, and 1500 <br /> Rose Avenue; and <br /> <br />WHEREAS, the property is zoned PUD-MDR (Planned Unit Development - Medium Density <br /> Residential) District; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by <br /> Council on October 26, 1999; and <br /> <br />WHEREAS, at its meeting of September 22, 1999, the Planning Commission recommended <br /> approval of the PUD development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on October 26, 1999; and <br /> <br />WHEREAS, the City Council finds that the proposed project will be compatible with the rural <br /> character of the Rose Avenue area. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves Case PUD-99-05, the application of SummerHill Homes for PUD <br /> development plan approval to allow the subdivision of a 15.2+ acre site (two <br /> existing parcels) into 36 lots ranging in size from approximately 11,387 square feet <br /> to 7,787 square feet, including five affordable unit lots, with an approximately <br /> 1.8-acre remainder site with two existing homes located at 1015, 1027, and 1500 <br /> Rose Avenue, subject to the conditions shown on "Exhibit B", attached hereto and <br /> incorporated herein by this reference. <br /> <br /> <br />
