<br />reduced from seven to six. More landscaping has been provided, and many of staff's concems <br />have been addressed. Staff believed this infill site must relate to the design and development <br />standards of the Downtown residential area, minimizing the impacts on nearby residents. The <br />development exceeded the high-density residential midpoint of 15 density units per acre with <br />23 dwelling units per acre. Staff believes the project blends in well with the Downtown <br />character and that the residents will enliven Downtown by being able to walk to shops and other <br />businesses. Staff recommended approval of this project and requested that the following <br />conditions be modified, as described in the memo distributed to the Commission: <br />1. Delete Condition No. 27.e. regarding recordation of the public service easements; <br />2. Modify Condition No. 32, third sentence, to read as follows: "After one year following <br /> acceptance of public improvements. . . the applicant shall replace the damaged or <br /> destroyed tree with a minimum of one 36-inch box tree Ofthll same f! species of the <br /> property owner's choice in approximately the same location." <br />3. Delete Condition No. 53 regarding natural gas burning fireplaces. <br />4. Add the following sentence at the end of Condition No. 67: "A temporary construction <br /> trailer shall be allowed on site durin!! construction for use durin!! the allowed hours of <br /> oDeration." <br />5. Delete the last sentence of Condition No. ll1.b., which reads: "The project developer <br /> shall enter into a maintenance agreement for the oil/water separator." <br />Ms. Decker further requested that the following conditions of approval be added: <br />1. All windows and doors shall have the appropriate STC rating, as indicated by the Noise <br /> Study prepared by Charles M. Salter, Exhibit A; <br />2. The use of "hardi-plank" or similar material shall be allowed for use as wood siding as a <br /> "green building" material; and <br />3. All existing and proposed electrical shall be placed underground, including the existing <br /> 21kV overhead line unless otherwise approved by the Planning Director and the Director <br /> of Public Works. <br />In response to an inquiry by Commissioner Fox regarding applicants' payment of in-lieu parking <br />fee for residential development, Ms. Decker replied that this was a first for a residential <br />development and was intended to mitigate community concerns about loss of parking in the <br />Downtown area. The applicant suggested the use of the in-lieu parking fee at a reduced rate of <br />$7,000 per space from the commercial requirement of $14,000 per space. Ms. Decker noted that <br />the City did not impose this fee on the applicant. <br />Commissioner Blank suggested that a condition be added requiring that carports not be used for <br />storage. <br />In response to an inquiry by Commissioner Roberts regarding whether any damage to the oak <br />tree would result in a fine, Ms. Decker replied that the arborist had assigned a value of $21 ,800 <br />to the tree. <br />Commissioner Roberts believed this item should have been presented as a workshop. <br />Ms. Decker noted that the applicant had worked with staff for a long time and added that <br />workshops are generally held when the Planning Department did not feel there was sufficient <br />direction for a project. <br />EXCERPTS: PLANNlNG COMMISSION MEETING MINUTES, May 11,2005 Page 2 of5 <br />
