<br /> , <br /> 40 <br /> '" <br />pLEASANTONc City Council <br /> Staff Report <br /> September 20, 2005 <br /> Police Department <br /> City Attorney's Office <br />SUBJECT: Amendment to the Pleasanton Municipal Code Concerning the Wearing of Helmets <br /> at Designated Park and Recreational Facilities <br />STAFF RECOMMENDATION: <br /> Adopt, as an urgency ordinance, amendments to the Pleasanton Municipal Code to <br /> prohibit persons from riding bicycles, skateboards and nonmotorized scooters, and <br /> from using in-line skates, in designated City's parks and recreation facilities unless <br /> they are wearing properly fitted and fastened helmets that meet standards provided <br /> in the California Vehicle Code. <br />SUMMARY: The City's bicycle motocross (BMX) riding facility was opened to the public in <br /> June 2005. Although the facility rules posted at the site include the requirement <br /> that all participants wear helmets, some participants are not wearing them. The <br /> proposed ordinance revises the Pleasanton Municipal Code to prohibit persons <br /> from riding bicycles in the BMX park unless they are wearing properly fitted and <br /> fastened bicycle helmets that meet set standards. The ordinance proposed also <br /> revises the Code to require that persons who use the skateboard park (in the Sports <br /> Park) and the in-line skate park (at Val Vista Community Park) wear properly <br /> fitted and fastened helmets that meet the same prescribed standards. This revision <br /> will make consistent a helmet requirement for bicyclists, in-line skaters, riders of <br /> non-motorized scooters and skateboarders who use designated City recreation <br /> facilities. The ordinance proposed is being presented as an urgency ordinance <br /> because it will provide the Police Department with express authority to <br /> immediately enforce the helmet requirement to protect the safety of participants at <br /> the BMX facility, skateboard park and in-line skate park. <br />Honorable Mayor and Members of the City Council: <br />BACKGROUND <br />The City's BMX riding facility, which opened in June 2005, was designed to provide BMX <br />enthusiasts a riding facility in Pleasanton.
