CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> ORDINANCE NO. 1797 <br /> <br /> AN ORDINANCE OF THE CITY OF PLEASANTON AMENDING <br /> CHAPTER 11.44, REMOVAL OF ABANDONED VEHICLES <br /> FROM PRIVATE PROPERTY, AND DECLARING THE <br /> URGENCY THEREOF. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Title 11, Vehicles and Traffic, of the Pleasanton Municipal Code shall be amended to <br /> read as follows: <br /> <br /> "Chapter 11.44 Removal of Abandoned Vehicles from Private Property <br /> <br /> 11.44.010 - 11.44.020, no changes. <br /> <br /> 11.44.030 Definitions. As used in this Chapter: <br /> <br />A. "Abandoned" means that a vehicle, or any part thereof, that is: (1) parked, stored or left on public <br /> property in such inoperable or neglected condition that the owner's intention to relinquish all <br /> rights or interest in it may be reasonably concluded; or (2) wrecked, dismantled or inoperative <br /> and is parked, stored or left on public or private property, except as provided in section <br /> 11.44.040 of this Chapter. <br /> <br />B. "Chief of Police" means the Chief of Police or Chief of Police's designee. <br /> <br />C. "City Manager" means the City Manager or City Manager's designee. <br /> <br />D. "Dismantled" means that a vehicle that is in violation of California Vehicle Code Section 24002. <br /> <br />E. "Highway" means a way or place of whatever nature, publicly maintained and open to the use of <br /> the public for purposes of vehicular travel. "Highway" includes "street". <br /> <br />F. "Inoperative" means that a vehicle that is: <br /> (1) mechanically incapable of being driven safely on a public street or highway; or <br /> (2) prohibited from being operated on a public street or highway under the Califomia Vehicle <br /> Code Sections 4000, 5202, 24002, or 40001, concerning license plates, registration, equipment, <br /> safety and related matters. <br /> <br /> <br />
