<br />ATTACHMENT A <br /> <br />USE AGREEMENT <br /> <br />THIS USE AGREEMENT, made this day of ,200_, by and <br />between the CITY OF PLEASANTON, a municipal corporation of the State of California <br />(referred to as "City"), and the PLEASANTON PARTNERSHIPS IN EDUCATION <br />FOUNDATION (referred to as "User"), <br /> <br />RECITALS <br /> <br />A. User is a nonprofit organization organized to provide services to support the <br />Pleasanton Unified School District. <br /> <br />B. User has been using two rooms of office space in the property commonly known <br />as the Downtown Annex Building located at 333 Division Street. <br /> <br />C. City desires to continue to provide office space to User and User desires to <br />continue using said space as memorialized in this Agreement. <br /> <br />IN CONSIDERATION of mutual covenants contained herein, the parties agree as follows: <br /> <br />1. fuillject of Agreement. City allows User to use rooms X and Y (referred to as <br />"Rooms" as noted on A IT A CHMENT A) located in the building commonly known as the <br />Downtown Annex Building (referred to as "Building") located at 333 Division Street, Pleasanton <br />(referred to as "Property") for the purposes contained herein. User shall also have access to the <br />Building's restrooms and kitchen, and may use the meeting room (Z), provided it is prescheduled <br />with the City through the Department. <br /> <br />2. <br />terminate on <br /> <br />Thrill. This Agreement shall be effective on , 2005 and shall <br />, 2006, except as otherwise provided in this Agreement. <br /> <br />3. Rental. User covenants and agrees to pay City as rent for one year the sum of <br />ONE AND NO/IOOTHS DOLLAR (~1.00). <br /> <br />4. Purposes. The Rooms shall be used exclusively for the purpose of providing <br />space for User's volunteer activities related to supporting the Pleasanton Unified School District. <br />User shall not commit, suffer or permit any waste or nuisance on the Property. User shall not use <br />store or dispose of any hazardous materials on the Property. <br /> <br />5. &pairs and Maintenance. The Property is in an "as is" condition and User agrees <br />to assume the risk of any structural or other deficiencies which may exist. User shall keep the <br />Rooms in good repair during the term of this Agreement at User's own expense, and upon <br />termination of this Agreement shall return the Rooms to City in good condition and repair <br />(ordinary wear excepted). City shall maintain the grounds, Building roof and exterior walls, <br /> <br />1 <br />
