Box 520 <br />Pleasanton, CA 94566 <br /> <br /> DEVELOPMENT AGREEMENT <br /> <br /> THIS DEVELOPMENT AGREEMENT ("the Development Agreement") is made and <br />entered into this __ day of ,1999, by and between the CITY OF PLEASANTON, a <br />municipal corporation ("City"), and TTK Partnership, a California general partnership <br />("Developer"). <br /> <br /> RECITALS: <br /> <br /> A. Developer owns certain real property ("the Property") consisting of approximately 46.3 <br />acres and identified as Lots 109 and 110 in the Happy Valley Specific Plan CHVSP"), a portion of <br />which Property is to be a part of the development known as the proposed Pleasanton Municipal Golf <br />Course. The Property is more particularly described on Exhibit "A", attached to this Agreement and <br />made a part of it by reference. <br /> <br /> B. The City has granted Developer development plan approval for the development of the <br />Property ("the Development") pursuant to PUD 99-07. The Development consists of a residential <br />subdivision consisting of 12 building sites, a public equestrian/pedestrian trail, public streets and <br />parking, and land set aside for the Pleasanton Municipal Golf Course and for permanent open space. <br /> <br /> C. Developer has entered into a written agreement with New Cities Development Group and <br />Black Mountain Development whereby Developer will contribute, on a pro-rata basis, to the <br />construction cost of extending water and sewer main lines and laterals to existing Happy Valley <br />Specific Plan area residents. A copy of this agreement is attached hereto as Exhibit "B" and is made <br />a part of it by reference. <br /> <br /> D. California Government Code section 65864 et seq., provides that the legislative body of <br />a city may enter into a development agreement for the development of real property in order to vest <br />certain rights in the developer and to meet certain public purposes of the local government. Developer <br />has applied to the City pursuant to Government Code sections 65864-65869.5 and for approval of <br />the Development Agreement set forth herein. <br /> <br /> E. The Developer and the City desire to enter into this Development Agreement in order to <br />facilitate the development of the Property. <br /> <br /> <br />
