CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1794 <br /> <br /> AN ORDINANCE CONDITIONALLY APPROVING A <br /> DEVELOPMENT AGREEMENT BETWEEN THE CITY OF <br /> PLEASANTON AND TTK PARTNERSHIP <br /> <br />WHEREAS, Government Code Section 65864 through Section 65869.5 authorizes cities and <br /> counties to enter into binding development agreements with persons having legal <br /> or equitable interests in real property for the development of such property; and <br /> <br />WHEREAS, TTK Partnership has made application to the City to enter into such an agreement <br /> provided for in the Govemment Code in conjunction with its application for <br /> approval of a development plan; and <br /> <br />WHEREAS, the environmental impact report (EIR) certified as adequate for the Happy Valley <br /> Specific Plan area encompasses the effects of the project as provided for in the <br /> development agreement; and <br /> <br />WHEREAS, after public notice, the Planning Commission held a hearing on July 14, 1999 and <br /> recommended approval of the development plan; and <br /> <br />WHEREAS, after public notice, the Planning Commission held a heating on October 13, 1999 <br /> and recommended approval of the development agreement; and <br /> <br />WHEREAS, a duly noticed public hearing on the development plan and the development <br /> agreement was held on October 19, 1999 before the City Council; and <br /> <br />WHEREAS, the City Council conditionally approved the development plan for the site; <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section 1: Finds that the proposed Development Agreement for TTK Partnership is consistent <br /> with the City's General Plan and the Happy Valley Specific Plan. <br /> <br />Section 2: Approves the Development Agreement between the City of Pleasanton and TTK <br /> Partnership, a copy of which is attached hereto and incorporated herein by this <br /> reference. <br /> <br /> <br />
