CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1794 AN ORDINANCE CONDITIONALLY APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF PLEASANTON AND TTK PARTNERSHIP WHEREAS, Government Code Section 65864 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, TTK Partnership has made application to the City to enter into such an agreement provided for in the Govemment Code in conjunction with its application for approval of a development plan; and WHEREAS, the environmental impact report (EIR) certified as adequate for the Happy Valley Specific Plan area encompasses the effects of the project as provided for in the development agreement; and WHEREAS, after public notice, the Planning Commission held a hearing on July 14, 1999 and recommended approval of the development plan; and WHEREAS, after public notice, the Planning Commission held a heating on October 13, 1999 and recommended approval of the development agreement; and WHEREAS, a duly noticed public hearing on the development plan and the development agreement was held on October 19, 1999 before the City Council; and WHEREAS, the City Council conditionally approved the development plan for the site; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Finds that the proposed Development Agreement for TTK Partnership is consistent with the City's General Plan and the Happy Valley Specific Plan. Section 2: Approves the Development Agreement between the City of Pleasanton and TTK Partnership, a copy of which is attached hereto and incorporated herein by this reference.
