<br /> <br /> <br />LEASANTON. <br /> <br />City Council <br />Staff Report <br /> <br />September 20, 200) <br />City Attorney's Office <br />Planning Department <br /> <br />SUBJECT: <br /> <br />WAIVER OF AGRICULTURAL PRESERVE (WILLIAMSON ACT) <br />CONTRACT FEES ON PROPERTY OWNED BY CENTEX HOMES <br />WITHIN THE VINEYARD AVENUE CORRIDOR SPECIFIC PLAN <br /> <br />STAFF RECOMMENDATION: <br /> <br />Adopt the attached resolution waiving the Williamson Act fees on about <br />21.) acres within the Vineyard Avenue Corridor Specific Plan area and <br />request the State Resources Agency Secretary to approve the waiver. <br /> <br />SUMMARY: Centex Homes owns property within the City of Pleasant on and within the <br />Vineyard Avenue Corridor Specific Plan area. That property (totaling <br />about 21 j acres) was subject to a Williamson Act contract that prohibits <br />the residential development of the property. Previously, Centex requested <br />that the contract be cancelled. Last month, the City cancelled the contract <br />on the Centex Homes property. When a contract is cancelled, the <br />landowner is required to pay a cancellation fee, 12,m of the cancellation <br />value of the property. The cancellation fee, however, may be waived if the <br />city council makes certain findings and the waiver is thereafter approved by <br />the State Resources Agency Secretary. Centex has requested that the <br />cancellation fee be waived in order that those funds are available to assist in <br />the relocation of the asphalt plant located to the north. Staff believes the <br />necessary findings for waiving the fees can be made and the attached <br />resolution waives the cancellation fee. <br /> <br />SR 05:170 <br />Page 1 <br />
