for work at the Project site. Developer shall require each contractor and subcontractor similarly to <br />provide Workers Compensation insurance for its respective employees. Developer agrees to <br />indemnify the City for any damage resulting from Developer's failure to maintain any such <br />insurance. <br /> <br /> 20.3 Evidence of Insurance. Prior to City Council approval of this Agreement, <br />Developer shall furnish City satisfactory evidence of the insurance required in Sections 20.1 and <br />20.2 and evidence that the carrier is required to give the City at least thirty (30) days prior written <br />notice of the cancellation or reduction in coverage of a policy. <br /> <br /> 21. Permitted Delays. In addition to any specific provisions of this Agreement, <br />performance of obligations hereunder shall be excused and the term of this Agreement shall be <br />similarly extended during any period of delay caused at any time by reason of: acts of God such as <br />floods, earthquakes, fires, or similar catastrophes; wars, riots or similar hostilities; strikes and other <br />labor difficulties beyond the Party's control; shortage of materials; the enactment of new laws or <br />restrictions imposed or mandated by other governmental or quasi-govemmental entities preventing <br />this Agreement from being implemented; litigation involving this Agreement or the Project <br />Approvals, which delays any activity contemplated hereunder; or other causes beyond the Party's <br />control. City and Developer shall promptly notify the other Party of any delay hereunder as soon as <br />possible after the same has been ascertained. <br /> <br /> 22. Notices. All notices required or provided for under this Agreement shall be in <br />writing and delivered in person or sent by certified mail, postage prepaid, by ovemight deliver or by <br />facsimile.
