CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1792 <br /> <br /> AN ORDINANCE CONDITIONALLY APPROVING A <br /> DEVELOPMENT AGREEMENT BETWEEN THE CITY OF <br /> PLEASANTON AND NEW CITIES DEVELOPMENT GROUP <br /> <br />WHEREAS, Govemment Code Section 65864 through Section 65869.5 authorizes cities and <br /> counties to enter into binding development agreements with persons having legal <br /> or equitable interests in real property for the development of such property; and <br /> <br />WHEREAS, New Cities Development Group has made application to the City to enter into such <br /> an agreement provided for in the Government Code in conjunction with its <br /> application for approval of a development plan; and <br /> <br />WHEREAS, the environmental impact report (EIR) certified as adequate for the North <br /> Sycamore Specific Plan area encompasses the effects of the project as provided for <br /> in the development agreement; and <br /> <br />WHEREAS, after public notice, the Planning Commission held a hearing on May 12, 1999 and <br /> denied the development plan; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant <br /> appealed the decision to the City Council; and <br /> <br />WHEREAS, after public notice, the Planning Commission held a hearing on October 13, 1999 <br /> and recommended that the proposed development agreement for the development <br /> plan also be denied; and <br /> <br />WHEREAS, a duly noticed public hearing conceming the development plan and the <br /> development agreement was held on October 19, 1999 before the City Council; <br /> and <br /> <br />WHEREAS, the City Council conditionally approved the development plan for the site; <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Finds that the proposed Development Agreement for New Cities Development <br /> Group is consistent with the City's General Plan and the North Sycamore Specific <br /> Plan. <br /> <br /> <br />
