CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1792 AN ORDINANCE CONDITIONALLY APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF PLEASANTON AND NEW CITIES DEVELOPMENT GROUP WHEREAS, Govemment Code Section 65864 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, New Cities Development Group has made application to the City to enter into such an agreement provided for in the Government Code in conjunction with its application for approval of a development plan; and WHEREAS, the environmental impact report (EIR) certified as adequate for the North Sycamore Specific Plan area encompasses the effects of the project as provided for in the development agreement; and WHEREAS, after public notice, the Planning Commission held a hearing on May 12, 1999 and denied the development plan; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant appealed the decision to the City Council; and WHEREAS, after public notice, the Planning Commission held a hearing on October 13, 1999 and recommended that the proposed development agreement for the development plan also be denied; and WHEREAS, a duly noticed public hearing conceming the development plan and the development agreement was held on October 19, 1999 before the City Council; and WHEREAS, the City Council conditionally approved the development plan for the site; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Finds that the proposed Development Agreement for New Cities Development Group is consistent with the City's General Plan and the North Sycamore Specific Plan.
