Exhibit B <br /> Final Conditions of Approval <br /> PUD-97-12 <br /> New Cities' Sycamore Heights <br /> October 19, 1999 <br /> City Council <br /> <br /> Planning <br /> <br />1. Development shall be substantially as shown on the development plans, Exhibit "A", <br /> dated "Received August 26, 1999" on file with the Planning Department, except as <br /> modified by the following conditions. Minor changes to the plans may be allowed <br /> subject to the approval of the Planning Director if found to be in substantial conformance <br /> to the approved exhibits. <br /> <br />2. The PUD development plan shall be modified to result in a 49-1ot plan (48 new lots and <br /> one existing residence) by eliminating Lots 32, 33, and 34. The area formerly contained <br /> within these three lots shall become open space. This revised lotting configuration shall <br /> be shown on the tentative map submitted for the review and approval by the Planning <br /> Commission. <br /> <br />3. This PUD shall be subject to the uses of the R-1 zoning district. <br /> <br />4. No grading shall be permitted on the project site until an access to the project site is <br /> available through the Greenbriar property extending from Sunol Boulevard to the westem <br /> edge of the project site. It shall be the determination of the Planning Director and City <br /> Engineer as to when this access is deemed available for use. No framing operations for <br /> the proposed structure shall commence until such time that the Planning Director and Fire <br /> Marshall determine that the new water tank that will serve the NSSP area is operational <br /> and provides a satisfactory flow of water necessary for fire suppression. No occupancy of <br /> the structures shall be permitted until it is determined that the new NSSP off-site streets <br /> that provide a public access to the property are safe and available for use. It shall be the <br /> determination of the Planning Director and City Engineer as to when this access is <br /> deemed available for use. <br /> <br />5. The applicant shall obtain all building and other applicable City permits for the project <br /> prior to the commencement of construction. <br /> <br />6. The developer shall revise the site plan, grading and utility plan, preliminary landscape <br /> plan, site sections, and all other applicable exhibits to reflect the following conditions of <br /> <br /> <br />
