d. Create a contained and covered area on the site for the storage of bags, cement, <br /> paints, oils, fertilizers, pesticides, or other materials used on the site that have the <br /> potential of being discharged into the storm drain system through being windblown or in <br /> the event of a material spill. <br /> <br /> e. Never clean machinery, equipment, tools, brushes, or rinse containers into a street, <br /> gutter, or storm drain. <br /> <br />89. Ensure that concrete/gunite supply trucks or concrete/plaster operations do not discharge <br /> wash water into street, gutters, or storm drains. <br /> <br /> Miscellaneous <br /> <br />90. The developer acknowledges that the City of Pleasanton does not guarantee the <br /> availability of sufficient sewer capacity to serve this development by the approval of this <br /> case, and that the developer agrees and acknowledges that building permit approval may <br /> be withheld if sewer capacity is found by the City not to be available. <br /> <br />91. This approval does not guarantee the availability of sufficient water to serve the project. <br /> The City shall withhold building permits for the project if at the time building permits are <br /> applied for, mandatory water rationing is in effect, unless the City has adopted a water <br /> offset program and unless the developer is participating in the program. Notwithstanding <br /> the developer's participation in such a program, the City may withhold building permits if <br /> the City determines that sufficient water is not available at the time of application of <br /> building permits. <br /> <br />92. The applicant shall record CC&R's at the time ofrecordation of the final map which shall <br /> create a homeowners association for the development. The CC&R's shall be subject to <br /> the review and approval of the City Attorney prior to recordation of the final map. <br /> Common areas within this development not covered by the areawide NSSP homeowners <br /> maintenance association shall be maintained by the homeowners association for this <br /> project. The project's homeowners association shall be responsible for implementing all <br /> storm water measures and for the maintenance of all private streets, private utilities, <br /> creekbed and open space area, and other common areas and facilities on the site. <br /> Landscaping shall be designed with efficient irrigation to reduce runoff, promote surface <br /> filtration, and minimize the use of fertilizers, herbicides, and pesticides which can <br /> contribute to storm water runoff pollution. All landscaping extending to the sidewalk <br /> along "A" Street within the development shall be maintained as part of the NSSP <br /> homeowners maintenance association. The developer shall secure the necessary <br /> agreements making these lots and streetscape areas in this development part of this <br /> areawide maintenance association prior to the approval of the final map. The developer <br /> shall provide a plan outlining which of the common areas would be maintained by this <br /> <br /> <br />
