CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1790 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> MARDELL LLC FOR PUD DEVELOPMENT PLAN <br /> APPROVAL, AS FILED UNDER CASE PUD-99-01 <br /> <br />WHEREAS, Mardel LLC has applied for PUD development plan approval for 12 new <br /> residential lots, one existing residential lot with an existing second unit, and open <br /> space located at 4456 Foothill Road; and <br /> <br />WHEREAS, the property is zoned PUD-LDR/RDR/A (Planned Unit Development - Low <br /> Density Residential/Rural Density Residential/Agricultural) District and <br /> WFRCOD (West Foothill Road Corridor Overlay) District; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by <br /> Council on September 20, 1999; and <br /> <br />WHEREAS, the City Council finds that the proposed PUD development plan meets the intent of <br /> the current West Foothill Road Corridor Overlay District and West Foothill Road <br /> Corridor Design Guidelines, and is consistent with the General Plan and the <br /> purposes of the PUD ordinance. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves Case PUD-99-01, the application of Mardel LLC for PUD development <br /> plan approval for 12 new residential lots, one existing residential lot with an <br /> existing second unit, and open space located at 4456 Foothill Road, subject to the <br /> conditions shown on "Exhibit B", attached hereto and incorporated herein by this <br /> reference. <br /> <br />Section 2: A summary of this ordinance shall be published once within fifteen (15) days after <br /> its adoption in "The Valley Times," a newspaper of general circulation published <br /> in the City of Pleasanton, and the complete ordinance shall be posted for fifteen <br /> (15) days in the City Clerk's office within fifteen (15) days after its adoption. <br /> <br />Section 3: This ordinance shall be effective thirty (30) days after the date of its final passage <br /> and adoption. <br /> <br /> <br />
