consultant to conduct a field inspection prior to issuance of grading permits to ensure <br /> that all recommendations have been properly implemented. The consultant shall <br /> certify in writing that such recommendations have been followed. No trees shall be <br /> removed other than those specifically designated for removal on the approved plans or <br /> tree report. The applicant shall post cash, letter of credit, or other security satisfactory <br /> to the Planning Director in the amount of $5,000 for each tree required to be <br /> preserved, up to a maximum of $25,000. This cash bond or security shall be retained <br /> for one year following acceptance of public improvements or completion of <br /> construction, whichever is later, and shall be forfeited if the trees are destroyed or <br /> substantially damaged. <br /> <br />Schools <br /> <br />32. The developer shall fund school facilities necessary to off-set this project's reasonably <br /> related impacts on the long-term needs for expanded school facilities to serve new <br /> development in Pleasanton. Determination of the method and manner of the <br /> provision of the funds and/or facilities shall be made by the Pleasanton Unified <br /> School District and the City, and it may be in addition to the school impact fees <br /> required by State law and local ordinance. The program shall be a successor to the <br /> documents entitled "Cooperation Agreement" and "Flat Fee Agreement", and shall <br /> specifically include the project's obligation to fund its share of all future schools, <br /> including whatever high school option is selected by the Pleasanton Unified School <br /> District. The project developer shall be required to participate in the above- <br /> referenced program, or in any successor program, prior to issuance of any building <br /> permit for the project. <br /> <br />33. No building permit shall be issued or lot sold for any of the new homes within this <br /> project until after the new elementary school and Middle School are operational. The <br /> applicant may request modification of this condition based on the progress being <br /> made on the construction of these new schools with the intent being that no home <br /> shall be occupied until the schools are open. <br /> <br />Building Department Requirements <br /> <br />34. All dwelling units in the development shall be constructed to meet Title 24 state <br /> energy requirements. <br /> <br />35. All building and/or structural plans must comply with all codes and ordinances in <br /> effect before the Building Department will issue permits. <br /> <br /> Page 8 <br /> <br /> <br />
