 CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, ALAMEDA <br /> RESOLUTION NO. 05-063 <br /> <br /> RESOLUTION DETERMING SATISFACTORY COMPLIANCE <br /> WITH CONDITIONS FOR CANCELING AGRICULTURAL <br /> PRESERVE CONTRACT 1974-10B AND AUTHORIZING THE <br /> CITY CLERK TO PREPARE AND RECORD A CERTIFICATE <br /> OF CANCELLATION <br /> <br /> WHEREAS, the City received of an application to cancel Agricultural Preserve Contract <br /> 1974-10B under the provisions of California Government Code Sections 51280 et <br /> seq., to allow development of the site for residential use consistent with the <br /> policies of the City General Plan and the Vineyard Avenue Corridor Specific Plan; <br /> and <br /> <br /> WHEREAS, on December 7, 2004, Council adopted Resolution No. 04-096 approving tentative <br /> cancellation of said Contract and setting forth conditions to be satisfied prior to <br /> final cancellation; and <br /> <br /> WHEREAS, Centex Homes has deposited the amount of the cancellation fee, is prepared to <br /> record a final map for the site and has requested that the Council determine that <br /> the conditions of Resolution No. 04-096 have been satisfactorily complied with; <br /> and <br /> <br /> WHEREAS, Council received the City staff's report and recommendation concerning this <br /> matter; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br /> AS FOLLOWS: <br /> <br /> Section 1: The City Council determines that the conditions and contingencies set forth in <br /> Resolution No. 04-096 have been satisfied for the cancellation of Agricultural <br /> Preserve Contract 1974-10B, removing 21.5 & acres of land (Tract 7385) from the <br /> Contract. <br /> <br /> Section 2: Council authorizes and directs the City Clerk to execute the Certificate of <br /> Cancellation for said Contract and to cause same to be recorded and a copy sent to <br /> the State Director of Conservation. <br /> <br /> Section 3: This resolution shall take effect immediately upon its adoption. <br /> <br /> <br />
