Honorable Mayor and Members of the City Council: <br /> <br />BACKGROUND <br /> <br />On March 1, 2005, as part of the 2005 LPFD's Weed Abatement Program, the City Council <br />adopted Resolution No. 05-012, which declared that weeds on specified properties constituted a <br />public nuisance, ordered the abatement thereof, and set a public hearing to hear objections to the <br />proposed abatement. On April 5, 2005, the City Council adopted Resolution No. 05-017, which <br />ordered the abatement of weeds on the parcels identified in Resolution No. 05-012 and declared <br />that the weed abatement costs were the property owner's responsibility. On July 19, 2005, the <br />City Council adopted Resolution No. 05-196, which (1) declared that the costs of weed <br />abatement are a special assessment and lien imposed on specified properties and (2) approved a <br />cost accounting report for the weed abatement program. <br /> <br />Union Pacific Railroad owns 15 parcels that were listed on the abatement list. Prior to the City <br />Council's meeting on July 19, 2005, Union Pacific had not abated the weeds on its parcels and <br />the City's contractor had not been able to complete the abatement of the weeds on the property. <br />In order to ensure that the abatement costs for all of the parcels, other than those owned by <br />Union Pacific Railroad, were timely added to the County's 2005-2006 tax assessors roll, on July <br />19, 2005, staff presented the City Council a list of properties on which weeds had been abated <br />by the City's contractor and City work crew. Since July 19, 2005, the work on the Union <br />Pacific Railroad parcels has been completed in accordance with LPFD standards. <br /> <br /> The attached resolution includes a supplemental itemized report for the cost of weed abatement <br /> for the Union Pacific Railroad parcels throughout the City of Pleasanton. The purpose of this <br /> public hearing is for the City Council to (1) hear and consider any objections to the <br /> supplemental cost accounting report for the LPFD's 2005 Weed Abatement Program in the City <br /> of Pleasanton, (2) declare that the costs of weed abatement on the Union Pacific Railroad <br /> properties are a special assessment and lien imposed on the properties and (3) approve the <br /> attached supplemental cost accounting report for the weed abatement program. <br /> <br /> The LPFD recommends that the City Council adopt the attached resolution that approves the <br /> Supplemental Cost Accounting Report for the 2005 Weed Abatement Program and declares that <br /> the abatement costs are a special assessment and lien imposed on the Union Pacific Railroad <br /> properties that required abatement. <br /> <br /> FISCAL IMPACT <br /> All administrative costs involved with the Weed Abatement Program are budgeted under <br /> Account # 122-181-4344 and are reimbursable. <br /> <br /> SR:05:225 <br /> <br /> <br />
