pL£AS&NTONo City¢oun¢il <br /> Staff Report <br /> <br /> August 16, 2005 <br /> Law Department <br /> <br />SUBJECT AGREEMENT WITH CENTEX HOMES CONCERNING THE USE <br /> OF FEES <br /> <br />STAFF RECOMMENDATION: <br /> <br /> Authorize the City Manager to sign the attached Agreement. <br /> <br />SUMMARY Centex Homes, the developer of Tract 7385 in the Vineyard Avenue <br /> Corridor Specific Plan area, is obligated to pay a fee in order to cancel an <br /> agricultural preserve (Williamson Act) contract on the property. That fee is <br /> $562,500. That fee, however, may be waived (by the City and by the State <br /> Resources Agency) if certain findings are made. Centex has requested that <br /> the fees be waived and the funds used to help with the cost to locate the <br /> asphalt plant located adjacent to the Specific Plan area. (That request will <br /> be before Council in September.) Centex has also agreed to make available <br /> an additional $500,000. Those funds will be used either for energy efficient <br /> improvements to a number of homes within Tract 7385 (if the cancellation <br /> fees are waived and are used for relocation of the asphalt plant) or for the <br /> relocation costs if the cancellation fees are not waived. If the plant is not <br /> relocated within seven years, either the $562,500 or the $500,000 would be <br /> retained by the City as a donation from Centex and the funds used for other <br /> energy efficient projects in the City. <br /> <br /> Honorable Mayor and Members of the City Council: <br /> <br /> BACKGROUND <br /> <br /> Centex Homes is the developer of Tract 7385, a residential subdivision located within the <br /> Vineyard Avenue Specific Plan area.
