EXHIBIT B <br /> CONDITIONS OF APPROVAL <br /> <br /> PUD-99-1-3M, Alameda New Communities <br /> 4476 Tosca Court, 4462 Tosca Court, 8012 Oak Creek Drive, 8024 Oak Creek Drive, <br /> 8015 Oak Creek Drive, 8031 Oak Creek Drive, 8045 Oak Creek Drive, <br /> 4526 River Rock Hill Road, and 4538 River Rock Hill Road <br /> June 7, 2005 <br /> <br />1. The fence project shall be substantially as shown on the plans, Exhibit A, dated "Received <br /> April 6, 2005", on file with the Planning Department, except as modified by the following <br /> conditions of approval. Minor changes to the plans may be allowed subject to the review and <br /> approval of the Planning Director if found to be in substantial conformance to the approved <br /> exhibits. <br /> <br />2. Except as modified by the following conditions of approval, all conditions of <br /> Cases PUD-99-1 through PUD-99-1-2M shall remain in full force and effect. <br /> <br />3. Condition of Approval No. 13 of Case PUD-99-1, as shown below: <br /> <br /> "13. Fencing over six (6) feet in height shall not be allowed on Lots 1 to 12. Side <br /> and rear yard fencing on Lots 1 to 12 shall conform to the fencing plan <br /> submitted in Exhibit A. On Lots 1 to 12, solid privacy fencing is not <br /> allowed, except when it is not located in a required yard and it is screened <br /> by landscaping. On Lots 1 to 12, fencing shall not be allowed between the <br /> front of the home and the property line except for low open fences <br /> thirty (30) inches or less in height." <br /> <br /> Shall be modified to read follows: <br /> <br /> "13. Fencing over six (6) feet in height shall not be allowed on Lots 1 to 12. Side and <br /> rear yard fencing on Lots 1 to 12 shall conform to the fencing plan submitted in <br /> Exhibit A dated "Received August 13, 1999". On Lots 1 to 12, solid privacy <br /> fencing is not allowed unless it adheres to one of the two following exceptions: <br /> (1) except as shown on Exhibit A dated "Received April 6, 2005"; or (2) except <br /> when it is not located in a required yard and it is screened by landscaping. On <br /> Lots 1 to 12, fencing shall not be allowed between the front of the home and the <br /> property line except for low open fences thirty (30) inches or less in height." <br /> <br /> 4. Prior to installation of the solid fencing shown on Exhibit A dated "Received April 6, 2005," <br /> the applicant shall remove the open fencing located in the same place as the approved solid <br /> fencing. <br /> <br /> <br />
