Option 3: If the Council finds that it cannot support the proposed master expansion plan, <br /> but it can support the proposed Phase I construction only, it should deny the <br /> appeal and approve Phase I construction subject to the conditions of approval for <br /> Phase 1 in Exhibit B as modified by Exhibit C, Option 3. <br /> <br /> This option would require St. Clare's to apply for an amended master plan <br /> conditional use permit, building layout, and design review for Phase II and Phase <br /> III. It only provides for the Phase I expansion without assurances that Phases II <br /> and III will be supported by the City in the future. This was the action taken by <br /> the Planning Commission. <br /> <br /> Option 4: If the Council finds that it cannot make the findings to support the requested <br /> conditional use permit and design review, even for Phase I, then it should uphold <br /> the appeal (PAP-79) and deny Case Nos. PCUP-118/PDR-391 in their entirety. <br /> <br />PUBLIC COMMENTS <br /> <br />Notice for the appeal was sent to all property owners within 1,000 feet of the subject property. <br />Connie Cox, representing Valley Trails Homeowners Association (HOA), contacted staff, <br />indicating that the HOA was under the impression that St. Clare's would present a revised plan, <br />addressing neighbors' concerns, to the HOA prior to the hearing by the Planning Commission. <br /> <br />ENVIRONMENTAL ASSESSMENT <br /> <br />This project is categorically exempt from environmental review pursuant to California <br />Environmental Quality Act Guidelines, Section 15301, Existing Facilities, Class 1, <br />subsection 9(e)(2) (A) and (B). <br /> <br /> FISCAL IMPACT <br /> <br /> The proposed ordinance would have a negligible financial impact on the City. <br /> <br /> CONCLUSION <br /> <br /> Churches are a common use in residential areas, and when neighborhood issues are properly <br /> addressed, they are typically regarded as "good neighbors". In St. Clare's case, some neighbors <br /> have expressed concerns about the proposed expansion, resulting in the appeal to its expansion <br /> plans. <br /> <br /> SR:05:154 <br /> Page 12 <br /> <br /> <br />
