CONTRACT FOR CONSULTANT SERVICES <br /> FOR INSPECTION SERVICES FOR THE VALLEY AVENUE RAILRAOD <br /> UNDERCROSSING <br /> <br />THIS AGREEMENT is made and entered into this __ day of ., 2005, by and between <br />the CITY OF PLEASANTON, a municipal corporation ("City"), and S & C Engineers whose address <br />is 433 43rd Street, Oakland, CA 94609, and telephone number is (510) 597-1090, ("Consultant"). <br /> <br /> WITNESSETH: <br /> <br />A. Consultant is qualified to provide, and experienced in providing, inspection services and has <br />offered its services for the purposes specified in this Agreement. <br /> <br />B. In the judgment of the City, it is necessary and advisable to employ the services of Consultant for <br />the purposes provided herein. <br /> <br />NOW THEREFORE, in consideration of the mutual covenants, agreements and conditions contained <br />herein, City and Consultant agree as follows: <br /> <br />1. Consultant's Services. Consultant shall diligently perform the services and furnish the <br />materials, reports, drawings, and related materials as hereinafter set forth: <br /> <br /> a. Consultant shall perform all work described in Exhibit "A", Scope of Work, <br /> attached hereto and incorporated herein by this reference. <br /> <br /> b. Consultant shall meet with the technical staff of the City, other pertinent agencies, <br /> and/or landowners as necessary to complete the scope of work outlined in Section <br /> 1 (a) above. <br /> <br /> 2. City Services. In order to assist Consultant in this work, City shall provide, if necessary, title <br /> reports, any existing plans of the area on file, necessary direction and plan checking within a reasonable <br /> time. <br /> <br /> 3. Staff. The Project Manager for Consultant shall be Bill Carlson, who may not be replaced <br /> without written consent of City. <br /> <br /> 4. Sufficiency of Consultant's Work. All reports, drawings, plans and specifications prepared for <br /> City shall be adequate and sufficient to meet the purposes for which they are prepared. <br /> <br /> 5. Ownership of Work. All reports, drawings, plans and specifications, maps, designs, work data, <br /> and all other documents completed or partially completed by Consultant in the performance of this <br /> Agreement shall become the property of City. <br /> <br /> 6. Terms. Time is of the essence Consultant shall begin work upon receipt of any shop drawing for <br /> the Valley Avenue Undercrossing. The work as described in Exhibit "A", Scope of Work, shall be <br /> completed as follows: 10 working days maximum to return shop drawings; 48 hours maximum to <br /> SR:05:209 <br /> Page 6 of 10 <br /> <br /> <br />
