THE CITYOF 4N <br />DEEAS&NTONo cit Council <br /> Staff Report <br /> <br /> July 19, 2005 <br /> Law Department <br /> <br />SUBJECT CERTIFICATION OF TAXES AND ASSESSMENTS CONCERNING <br /> PROPOSITION 218 <br /> <br />STAFF RECOMMENDATION: <br /> <br /> Adopt the attached resolution certifying that the taxes and assessments that <br /> the City will request the County to place on the 2005/2006 tax rolls meet the <br /> requirements of Proposition 218 and authorizing the City Attorney to sign <br /> the Certification and Indemnification Agreement. <br /> <br />SUMMARY Every year cities throughout Alameda County request the County to place <br /> on upcoming property tax bills certain taxes and/or assessments levied by <br /> the cities. The County requires the cities to certify that these taxes and <br /> assessments comply with Proposition 218 before placing the items on the tax <br /> bill. The County also wants to be indemnified to the extent there is a legal <br /> challenge to any of the taxes or assessments. The attached resolution makes <br /> the necessary certification and authorizes the City Attomey to sign the <br /> attached Certification and Mutual Indemnification. To date, there have been <br /> no challenges to any of Pleasanton's taxes or assessments. <br /> <br />Honorable Mayor and Members of the City Council: <br /> <br /> BACKGROUND <br /> <br /> Every year cities (and some special districts) throughout Alameda County request the County to <br /> place on the property tax rolls taxes and assessments that the cities have levied. For example, <br /> Pleasanton requests that the assessments for the improvements within the Hacienda Business <br /> Park and for the assessments for landscape and lighting districts be collected with other property <br /> taxes. <br /> <br /> SR:05:200 <br /> Page 1 <br /> <br /> <br />
