THE CITY OF <br /> <br />pL£AS&NTON CityCouncil <br /> Staff Report <br /> <br /> July 19, 2005 <br /> Public Works Department <br /> <br />SUBJECT: APPROVAL OF IMPROVEMENT PLANS FOR THE CHANNEL <br /> RELOCATION ON THE BERNAL PROPERTY AND SECOND <br /> AMENDMENT TO THE VALLEY AVENUE EXTENSION <br /> UNDERPASS AGREEMENT <br /> <br />STAFF RECOMMENDATION: <br /> <br /> Staff recommends that the City Council take the following action at the <br /> meeting of July 19, 2005: <br /> <br /> Approve the improvement plans to relocate on the Bernal Property a <br /> portion of Zone 7's B-2 Channel and authorize the City Manager to sign <br /> the second amendment to the Valley Avenue Extension Underpass <br /> Agreement. <br /> <br />SUMMARY: The Preannexation Development Agreement with Bernal Investment <br /> Company, managed by Greenbriar Communities Homes, requires the <br /> developer to construct a separated grade crossing where the extension of <br /> Valley Avenue intersects the Union Pacific Railroad tracks. Council has <br /> previously approved improvement plans for this work and the developer <br /> will soon begin this construction. As part of this work, a portion of a Zone <br /> 7 storm drain channel needs to be relocated. Those plans have now been <br /> prepared and are presented to Council for approval. The attached Second <br /> Amendment to the Valley Avenue Extension Underpass Agreement sets <br /> forth the developer's obligation to relocate the channel. <br /> <br /> Honorable Mayor and Members of the City Council: <br /> <br /> BACKGROUND <br /> <br />The 2000 Bernal Property Specific Plan contemplated the extension of Valley Avenue from its <br />then existing terminus at Bernal Avenue to Junipero Street/Case Avenue.
