 CITY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, ALAMEDA <br /> RESOLUTION NO. 05-044 <br /> <br /> A RESOLUTION FINDING THAT CERTAIN FUNDS <br /> COLLECTED FROM DEVELOPERS ARE <br /> UNEXPENDED AFTER FIVE YEARS BUT THAT THE <br /> FUNDS ARE COMMITTED TO PARTICULAR <br /> PROJECTS <br /> <br /> WHEREAS, Government Code 66001(d), effective January 1, 1989, requires the City (a) <br /> to make findings once each fiscal year with respect to any portion of a fee <br /> remaining unexpended in its account five or more years after deposit of the <br /> fee, (b) to identify the purpose to which the fee is to be put and to <br /> demonstrate a reasonable relationship between the fee and the purpose for <br /> which it is charged, (c) to identify all sources and amounts of funding <br /> anticipated to complete financing and (d) to designate the approximate date <br /> the expected funding will be deposited; and <br /> <br /> WHEREAS, staff has reviewed the development fees collected between July 1, 1998 and <br /> June 30, 1999 to determine if any such development fees remain <br /> unexpended; and <br /> <br /> WHEREAS, staff has found that there are four development impact fees collected from <br /> developers for this period that remain unexpended; and <br /> <br /> WHEREAS, the City is committed to use one of the fees to reimburse a developer for the <br /> construction of capital improvements for which this fee has been collected <br /> and the City is committed to use one fee for construction of a capital <br /> improvement when certain environmental issues are resolved and the City <br /> is committed to use two of the fees for construction of capital <br /> improvements when future development occurs; and <br /> <br /> WHEREAS, staff has reviewed the development fees collected between July 1, 1993 and <br /> June 30, 1994 that received findings five years ago to determine if any such <br /> development fees still remain unexpended; and <br /> <br /> <br />
