PLANNING COMHISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-94-46(a) A RESOLUTION RECOMMENDING APPROVAL OF MODIFICATIONS TO THE FIRST AMENDMENT TO THE PHASE I AND PHASE II DEVELOPMENT AGREEMENTS BETWEEN THE CITY OF PLEASANTON AND PRUDENTIAL INSURANCE COMPANY GOVERNING THE HACIENDA BUSINESS PARK WHEREAS, Government Code Section 65865 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, Prudential Insurance Company has made application to the city for an amendment to the First Amendment to the Phase I and Phase II Development Agreements approved Resolution No. 1597 to reflect the addition of Lot 1F; and WHEREAS, The addition of Lot 1F to the provisions to the Development Agreements will not have any impact on any other previously approved provisions; and WHEREAS, at their duly noticed public hearing was held on August 31, 1994, the Planning commission, after considering all public testimony, relevant exhibits, and recommendations of the city staff concerning this proposal, recommended approval of the proposed negative declaration prepared for the proposed modification; and WHEREAS, the Planning Commission determined that the Amendment to the Development Agreements should better enable Hacienda Business Park to continue to be developed as a high quality business park. THE PLANNING COMMISSION OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1. The Commission finds that the proposed amendments to the Development Agreements between the City of Pleasanton and the Prudential Insurance company are consistent with the City'S General Plan. Section 2. Recommends approval of the amendments to the Development Agreements between the city of Pleasanton and the Prudential Insurance Company subject to the conditions contained within Exhibit "C", attached hereto and incorporated herein by this reference, and the final form of which is to be approved by the City Attorney.
