<br />PLANNING COMHISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-94-46(a) <br /> <br />A RESOLUTION RECOMMENDING APPROVAL OF MODIFICATIONS TO THE <br />FIRST AMENDMENT TO THE PHASE I AND PHASE II DEVELOPMENT <br />AGREEMENTS BETWEEN THE CITY OF PLEASANTON AND PRUDENTIAL <br />INSURANCE COMPANY GOVERNING THE HACIENDA BUSINESS PARK <br /> <br />WHEREAS, Government Code Section 65865 through Section 65869.5 <br />authorizes cities and counties to enter into binding <br />development agreements with persons having legal or <br />equitable interests in real property for the development of <br />such property; and <br /> <br />WHEREAS, Prudential Insurance Company has made application to the <br />city for an amendment to the First Amendment to the Phase <br />I and Phase II Development Agreements approved Resolution <br />No. 1597 to reflect the addition of Lot 1F; and <br /> <br />WHEREAS, The addition of Lot 1F to the provisions to the Development <br />Agreements will not have any impact on any other previously <br />approved provisions; and <br /> <br />WHEREAS, at their duly noticed public hearing was held on August 31, <br />1994, the Planning commission, after considering all public <br />testimony, relevant exhibits, and recommendations of the <br />city staff concerning this proposal, recommended approval <br />of the proposed negative declaration prepared for the <br />proposed modification; and <br /> <br />WHEREAS, the Planning Commission determined that the Amendment to <br />the Development Agreements should better enable Hacienda <br />Business Park to continue to be developed as a high quality <br />business park. <br /> <br />THE PLANNING COMMISSION OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1. <br /> <br />The Commission finds that the proposed amendments to <br />the Development Agreements between the City of <br />Pleasanton and the Prudential Insurance company are <br />consistent with the City'S General Plan. <br /> <br />Section 2. <br /> <br />Recommends approval of the amendments to the <br />Development Agreements between the city of Pleasanton <br />and the Prudential Insurance Company subject to the <br />conditions contained within Exhibit "C", attached <br />hereto and incorporated herein by this reference, and <br />the final form of which is to be approved by the City <br />Attorney. <br />
