<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-94-36 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A MAJOR MODIFICATION TO <br />AN APPROVED PLANNED UNIT DEVELOPMENT (LAGUNA OAKS <br />SUBDIVISION) AS FILED UNDER CASE PUD-89-S-1D-2M, THE <br />APPLICATION OF DAVIDON HOMES <br /> <br />WHEREAS, Davidon Homes has applied for a major modification to <br />an approved planned unit development (Laguna Oaks <br />Subdivision) for Land unit A to: 1) modify the <br />required side yard setback and separation requirements <br />of the 131 production lots, 2) modify the private <br />recreation area, and 3) modify the production lot house <br />plans located on an approximately 109 acre site at the <br />northeast intersection of Foothill Road and Bernal <br />Avenue; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned unit <br />Development) - Low Density Residential District; and <br /> <br />WHEREAS, at their duly noticed pUblic hearing of June 22, 1994, <br />the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />city staff concerning this application; and <br /> <br />WHEREAS, applications of this nature are categorically exempt <br />from the requirements of the California Environmental <br />Quality Act (CEQA)i and <br /> <br />WHEREAS, the Planning commission determined that the proposed <br />changes to Land unit A are appropriate and would not <br />significantly affect the development plan concept <br />approved as part of PUD-89-5 and PUD-89-5-1D. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Recommends approval of Case PUD-89-5-1D-2M, the <br />application of Davidon Homes for a major modification <br />to an approved planned unit development (Laguna Oaks <br />Subdivision) for Land unit A to: 1) modify the <br />required side yard setback and separation requirements <br />of the 131 production lots, 2) modify the private <br />recreation area, and 3) modify the production lot house <br />plans located on an approximately 109 acre site at the <br />northeast intersection of Foothill Road and Bernal <br />Avenue, subject to the conditions shown on Exhibit "C," <br />attached hereto and made part of this case by <br />reference. <br /> <br />.. 11 <br />
