<br />Resolution No. PC-94-33 <br />Page 4 <br /> <br />EXHIBIT B <br />Resolution NO. PC-94-33 <br />Conditions of Approval <br />Case UP-94-27 <br /> <br />1. The subject project shall be substantially as shown on the <br />development plans, Exhibit "A", dated "Received June 17, 1994" <br />on file with the Planning Department, except as modified by <br />the following conditions. Minor changes to the plans may be <br />allowed subject to the approval of the Planning Director if <br />found to be in substantial conformance to the approved <br />exhibits. <br /> <br />2. All building plans must comply with all codes and ordinances, <br />including the Pleasanton Fire Code (Chapter 20.24 of the <br />Pleasanton Municipal Code), in effect before the Building <br />Department will issue permits. <br /> <br />3. In the event complaints are received by the Planning Director <br />regarding parking, traffic, or other problems occurring as a <br />result of the operation of the espresso stand at this <br />location, the Director of Planning may refer the subject <br />project back to the Planning Commission for review; the <br />Planning commission may at that time attach new conditions as <br />necessary to eliminate/minimize the problem or may revoke the <br />conditional use permit. <br /> <br />4. Vehicles over 8' in height shall be restricted from entering <br />the drive-through lanes either with signs or other means <br />determined to be acceptable by the Planning Director. These <br />measures shall be shown on the final building permit plan set <br />for review and approval by the Planning Director prior to <br />issuance of a building permit. <br /> <br />5. Signage shall be limited to refacing the existing building <br />fascia sign cans and the necessary traffic control signs <br />required to direct drive-through traffic. No freestanding <br />signs are allowed. Final sign designs for the proposed use <br />shall be submitted to the Planning Director for review and <br />approval. <br /> <br />6. The applicant shall obtain all building and other applicable <br />City permits for the project prior to the commencement of <br />construction. <br /> <br />7. If the espresso stand ceases operation, the applicants shall <br />remove the structure and landscape tubs and shall repair and <br />restripe the parking lot back to its original condition. <br /> <br />II II <br />
