<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-94-29 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A MAJOR MODIFICATION TO <br />AN APPROVED PLANNED UNIT DEVELOPMENT AS FILED UNDER CASE <br />PUD-82-13-3M, THE APPLICATION OF TONY CHAN <br /> <br />WHEREAS, Tony Chan has applied for a major modification to <br />modify the governing PUD development plan to allow for <br />the removal of four (4) heritage size (100+ feet) <br />eucalyptus trees on the subject site located at 1 Deer <br />Oaks Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Low Density Residential/Open Space <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of June 8, 1994, <br />the Planning Commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, applications of this nature are categorically exempt <br />from the requirements of the California Environmental <br />Quality Act (CEQA); and <br /> <br />WHEREAS, the planning commission made the following findings: <br /> <br />1. Whether the plan is in the best interests of the <br />public health, safety, and general welfare: <br /> <br />The proposed removal would ensure the safety of <br />the applicant and his family by removing the trees <br />which present the risk to life and property. In <br />addition, the installation of replacement trees <br />would preserve the visual quality of the area. <br /> <br />2. Whether the plan is consistent with the city's <br />General Plan: <br /> <br />The city's General Plan contains a number of <br />provisions which seek to preserve the visual value <br />of the existing trees. The Plan also contains <br />provisions to protect the public health and <br />safety. The proposal strikes a good balance <br />between the preservation provisions and the public <br />health p~ovisions of the General Plan by allowing <br />removal of trees which present a safety problem, <br />retaining other heritage eucalyptus trees on the <br />property, and requiring replacement of the removed <br />tress with appropriate specimen trees. <br /> <br />,. <br /> <br />" <br />
