PC-94-24 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF A MAJOR MODIFICATION TO <br />AN APPROVED PLANNED UNIT DEVELOPMENT AS FILED UNDER CASE <br />PUD-91-19-1M, THE APPLICATION OF PETER SHUTTS <br /> <br />WHEREAS, Peter Shutts has applied for a major modification to <br />the Planned Unit Development to eliminate or extend the <br />June 5, 1994, expiration date for the development plan <br />approval for the construction of a single-family home <br />on a 1.25 acre portion of an approximately 2.40 acre <br />site located at 5226 Foothill Road; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit <br />Development) - Low Density Residential District; and <br /> <br />WHEREAS, at their duly noticed public hearing of May 11, 1994, <br />the Planning commission considered all public <br />testimony, relevant exhibits and recommendations of the <br />city staff concerning this application; and <br /> <br />WHEREAS, applications of this nature are categorically exempt <br />from the requirements of the California Environmental <br />Quality Act (CEQA); and <br /> <br />WHEREAS, the Planning Commission determined that an extension to <br />this development plan would benefit the subdivision of <br />which this lot is a part. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Recommends approval of Case PUD-91-19-1M, the <br />application of Peter Shutts for a major modification to <br />the Planned Unit Development to extend the expiration <br />date for the development plan approval for the <br />construction of a single-family home on a 1.25 acre <br />portion of an approximately 2.40 acre site located at <br />5226 Foothill Road to June 5, 1997, as long as the <br />construction of the road serving the lot begins by <br />September 1, 1995, and subject to the conditions shown <br />on Exhibit "B," attached hereto and made part of this <br />case by reference. <br /> <br />section 2. This resolution shall become effective immediately <br />upon its passage and adoption. <br /> <br />" <br /> <br />., <br />
