". PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-94-24 RESOLUTION RECOMMENDING APPROVAL OF A MAJOR MODIFICATION TO AN APPROVED PLANNED UNIT DEVELOPMENT AS FILED UNDER CASE PUD-91-19-1M, THE APPLICATION OF PETER SHUTTS WHEREAS, Peter Shutts has applied for a major modification to the Planned Unit Development to eliminate or extend the June 5, 1994, expiration date for the development plan approval for the construction of a single-family home on a 1.25 acre portion of an approximately 2.40 acre site located at 5226 Foothill Road; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - Low Density Residential District; and WHEREAS, at their duly noticed public hearing of May 11, 1994, the Planning commission considered all public testimony, relevant exhibits and recommendations of the city staff concerning this application; and WHEREAS, applications of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, the Planning Commission determined that an extension to this development plan would benefit the subdivision of which this lot is a part. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: section 1. Recommends approval of Case PUD-91-19-1M, the application of Peter Shutts for a major modification to the Planned Unit Development to extend the expiration date for the development plan approval for the construction of a single-family home on a 1.25 acre portion of an approximately 2.40 acre site located at 5226 Foothill Road to June 5, 1997, as long as the construction of the road serving the lot begins by September 1, 1995, and subject to the conditions shown on Exhibit "B," attached hereto and made part of this case by reference. section 2. This resolution shall become effective immediately upon its passage and adoption. " .,
