PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-94-23 RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER CASE UP-U-22, THE APPLICATION OF SYLVAN LEARNING CENTER (GINT A. FEDERAS) WHEREAS, Sylvan Learning Center (Gint A. Federas) has applied for a conditional use permit to allow a supplementary educational instruction facility for children and teens to be located within an existing building located at 1989 "D" Santa Rita Road (Mission Plaza Shopping Center); and WHEREAS, zoning for the property is C-C (Central Commercial) District; and WHEREAS, at their duly noticed public hearing of May 11, 1994, the Planning commission considered all public testimony, relevant exhibits and recommendations of the city staff concerning this application; and WHEREAS, the Planning Commission made the following findings: A. That the proposed location of the conditional use is in accordance with the objectives of the zoning ordinance and the purpose of the district in which the site is located. Some of the objectives of the zoning ordinance are to: foster a harmonious, convenient, workable relationship among land uses, protect existing land uses from inharmonious influences and harmful intrusions, and to insure that public and private lands ultimately are used for the purposes which are most appropriate and beneficial to the City as a whole. The subject building is located in Mission Plaza Shopping center which has typical commercial retail characteristics. As proposed, the use will not alter in any way the exterior appearance of the shopping center. As conditioned, the proposed use will be compatible with adjacent users in that it will occur completely indoors and in an office-like setting. The applicant can also be required to mitigate future nuisances which may arise as a result of the proposed use. The proposed use will provide a beneficial educational service to children of the community. 1I "
