<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-94-23 <br /> <br />RESOLUTION APPROVING A CONDITIONAL USE PERMIT AS FILED UNDER <br />CASE UP-U-22, THE APPLICATION OF SYLVAN LEARNING CENTER (GINT <br />A. FEDERAS) <br /> <br />WHEREAS, Sylvan Learning Center (Gint A. Federas) has applied for <br />a conditional use permit to allow a supplementary <br />educational instruction facility for children and teens <br />to be located within an existing building located at 1989 <br />"D" Santa Rita Road (Mission Plaza Shopping Center); and <br /> <br />WHEREAS, zoning for the property is C-C (Central Commercial) <br />District; and <br /> <br />WHEREAS, at their duly noticed public hearing of May 11, 1994, the <br />Planning commission considered all public testimony, <br />relevant exhibits and recommendations of the city staff <br />concerning this application; and <br /> <br />WHEREAS, the Planning Commission made the following findings: <br /> <br />A. That the proposed location of the conditional use <br />is in accordance with the objectives of the zoning <br />ordinance and the purpose of the district in which <br />the site is located. <br /> <br />Some of the objectives of the zoning ordinance are <br />to: foster a harmonious, convenient, workable <br />relationship among land uses, protect existing land <br />uses from inharmonious influences and harmful <br />intrusions, and to insure that public and private <br />lands ultimately are used for the purposes which <br />are most appropriate and beneficial to the City as <br />a whole. <br /> <br />The subject building is located in Mission Plaza <br />Shopping center which has typical commercial retail <br />characteristics. As proposed, the use will not <br />alter in any way the exterior appearance of the <br />shopping center. As conditioned, the proposed use <br />will be compatible with adjacent users in that it <br />will occur completely indoors and in an office-like <br />setting. The applicant can also be required to <br />mitigate future nuisances which may arise as a <br />result of the proposed use. The proposed use will <br />provide a beneficial educational service to <br />children of the community. <br /> <br />1I <br /> <br />" <br />
