CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 05-041 <br /> <br /> RESOLUTION APPROVING THE ABANDONMENT OF A PUBLIC SERVICE <br /> EASEMENT ALONG THE SOUTHERLY SIDE OF PARCEL 3 AND A SMALL <br /> PORTION OF PARCEL 4, PARCEL MAP 4779 AND ACCEPTANCE OF A <br /> STORM DRAIN EASEMENT ALONG THE NORTHERN SIDE OF PARCEL 3, <br /> PARCEL MAP 4779 <br /> <br />WHEREAS, in 1986, Spieker Partners received approval for a Planned Unit Development <br /> rezoning and development plan approval on a 13.3 acre site located at the <br /> northwest intersection of Rosewood Drive and Santa Rita; and <br /> <br />WHEREAS, in 1986, the City of Engineer accepted a grant of easement for public service <br /> purposes (10 foot wide) along the southerly line of Parcel 3 and a small portion of <br /> Parcel 4, the offer of dedication shown on Parcel Map 4779, submitted by Crow- <br /> Spieker-Singleton #112; and <br /> <br />WHEREAS, the City has determined the Public Service Easement (10 foot wide) along the <br /> southerly line of Parcel 3 and a small portion of Parcel 4 is not required; the <br /> property owner has requested the City to formally abandon the easement and has <br /> agreed to grant the City a storm drain easement over the actual location of the <br /> drainage system. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: The City Council hereby agrees to abandon the City's public service easement <br /> along the southerly line of Parcel 3 and a small portion of Parcel 4, and authorizes <br /> the City Manager to execute all necessary documents to abandon the easement. <br /> <br />Section 2: The City Council herby accepts a new public storm drain easement along the <br /> northerly line of Parcel 3, and authorizes the City Manager to accept and record all <br /> necessary documents for the City to accept such easement. <br /> <br />Section 3: This resolution shall become effective immediately upon its adoption. <br /> <br /> <br />
