<br />EXHIBIT A <br />Resolution No. PC-91-97 <br />Conditions or Approval <br /> <br />Case UP-91-69 <br /> <br />1. That the proposed use shall conform substantially to the site <br />plan, floor plan, and related materials, Exhibit A (dated <br />"Received October 25, 1991") on file with the Planning <br />Department, except as modified by these conditions. <br /> <br />2. That any changes to signage shall conform to the existing <br />approved comprehensive sign program for the Arbor complex. <br /> <br />3. That the use permit may be reviewed by the Planning Director <br />at any time to determine if additional conditions of approval <br />are necessary to ensure continued compatibility with <br />surrounding uses with respect to parking, traffic, noise, <br />compliance with state or federal laws, or other impacts. At <br />the discretion of the Planning Director, this use permit may <br />be referred to the Planning Commission for subsequent review <br />at a public hearing to add such conditions or, if deemed <br />necessary, to revoke the use permit. <br /> <br />4. That the applicant shall obtain all applicable City permits <br />for the proposed expansion and related improvements prior to <br />the expansion of the facility. <br /> <br />5. That the management of the gym shall inform all patrons <br />utilizing the facility before 8:00 pm or after 5:00 pm on any <br />day of the requirement to park on the front portion of the <br />site between the West Las positas Boulevard street frontage <br />and the Gold's Gym main building entrance. The management <br />shall be responsible for enforcing this provision. <br /> <br />6. That the applicant shall construct a noise muffling wall along <br />the northern wall of the existing tenant space to attenuate <br />noise from the proposed fitness/aerobics classes. The wall <br />shall be designed to achieve an STC rating of 55 (reference <br />Gypsum Association File #WP1520). If noise originating from <br />the gym becomes a nuisance to the neighboring tenant(s), the <br />use permit can be referred back to the Planning Commission for <br />additional conditions at the discretion of the Planning <br />Director. <br /> <br />7. That any modification in operation or any expansion of the use <br />shall require subsequent review by the Planning Director, who <br />may approve the modification if it is judged to be minor, or <br />may refer it to the Planning Commission for review if found to <br />be a substantial change. <br /> <br />8. That, except as modified by these conditions, all conditions <br />of the prior use permit (Case UP-S9-25) shall remain in full <br />force and effect. <br />
