<br />EXHIBIT A <br />ReSOlution No. PC-91-95 <br />Conditions or Approval <br /> <br />Case UP-91-75 <br /> <br />1. The location and operation of the health and fitness center shall <br />conform sUbstantially to the site plan, floor plan, details of <br />operation and related materials, Exhibit A (dated "Received <br />November 5, 1991"), on file with the Planning Department, except as <br />modified by these conditions. <br /> <br />2. The developer shall obtain all building and other applicable City <br />permits for the project prior to the commencement of construction. <br /> <br />3. The applicant shall obtain all necessary permits from the state, <br />including any requirements from the Dept. of Social Services for <br />the childcare facility, and County prior to beginning the operation <br />of the establishment. <br /> <br />4. If, at any time in the future, the activities of the operation <br />deviate from the above description or the ownership and/or <br />management of the health and fitness center are unable to control <br />the activities of patrons such that the presence of the center <br />encourages loud noise, litter, parking lot problems, etc., to the <br />detriment of the surrounding uses or to the City in general, the <br />Planning Director may refer this use permit to the Planning <br />Commission for review at a public hearing. If necessary, the <br />Planning Commission may add conditions or revoke the subject <br />conditional use permit per Municipal Code Section 18.124.130. <br /> <br />5. The applicant shall apply for and receive design review approval <br />for any proposed signs for the health and fitness center. The <br />signs shall be consistent with the previously-approved <br />comprehensive sign program for The Crossroads center. <br /> <br />6. The exercise and health education classes shall be scheduled with <br />15 minute intervals between each class. <br /> <br />7. The hours of operation of the health and fitness center shall be <br />6:00 am to 9:00 pm, Monday through Thursday; 6:00 am to 6:00 pm, <br />Friday; 8:00 am to 4:00 pm, Saturday; and 8:00 am to 4:00 pm, <br />Sunday. <br /> <br />8. The applicant shall construct a noise muffling wall along the <br />northern wall of Suite 4 to attenuate noise from the proposed <br />fitness/aerobics classes. The wall shall be designed to achieve an <br />STC rating of 55. If noise originating from the gym becomes a <br />nuisance to the neighboring tenant(s), the use permit can be <br />referred back to the Planning Director. <br />
