EXHIBIT A ReSOlution No. PC-91-95 Conditions or Approval Case UP-91-75 1. The location and operation of the health and fitness center shall conform sUbstantially to the site plan, floor plan, details of operation and related materials, Exhibit A (dated "Received November 5, 1991"), on file with the Planning Department, except as modified by these conditions. 2. The developer shall obtain all building and other applicable City permits for the project prior to the commencement of construction. 3. The applicant shall obtain all necessary permits from the state, including any requirements from the Dept. of Social Services for the childcare facility, and County prior to beginning the operation of the establishment. 4. If, at any time in the future, the activities of the operation deviate from the above description or the ownership and/or management of the health and fitness center are unable to control the activities of patrons such that the presence of the center encourages loud noise, litter, parking lot problems, etc., to the detriment of the surrounding uses or to the City in general, the Planning Director may refer this use permit to the Planning Commission for review at a public hearing. If necessary, the Planning Commission may add conditions or revoke the subject conditional use permit per Municipal Code Section 18.124.130. 5. The applicant shall apply for and receive design review approval for any proposed signs for the health and fitness center. The signs shall be consistent with the previously-approved comprehensive sign program for The Crossroads center. 6. The exercise and health education classes shall be scheduled with 15 minute intervals between each class. 7. The hours of operation of the health and fitness center shall be 6:00 am to 9:00 pm, Monday through Thursday; 6:00 am to 6:00 pm, Friday; 8:00 am to 4:00 pm, Saturday; and 8:00 am to 4:00 pm, Sunday. 8. The applicant shall construct a noise muffling wall along the northern wall of Suite 4 to attenuate noise from the proposed fitness/aerobics classes. The wall shall be designed to achieve an STC rating of 55. If noise originating from the gym becomes a nuisance to the neighboring tenant(s), the use permit can be referred back to the Planning Director.
