The conditions of approval, as well as the applicant's design of the tenant space the use will occupy, will ensure that the establishment remains within the standards of all applicable city codes. C. The proposed conditional use will comply with each of the applicable provisions of this chapter. The site's PUD zoning permits the establishment of health and fitness centers, as outlined by Municipal Code section 18.44.090 "Permitted and Conditional Uses in the C District". The proposed center complies with all relevant sections of the zoning ordinance. Granting a conditional use permit to Ira Jones for operating a health and fitness center is consistent with the City's ability to regulate zoning as listed in Municipal Code section 18.124 "Conditional Uses". WHEREAS, projects of this nature are categorically exempt from the requirements of the California Environmental Quality Act; and WHEREAS, the proposed health and fitness center, as conditioned, is appropriate for this site. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: section 1. Approves Case UP-91-75, the application of Ladies Fitness Center has applied for a conditional use permit to operate a ladies health and fitness center in an existing building at the Gateway Square commercial complex located at 4807 Hopyard Road, suite 1-4, subject to the conditions shown on Exhibit "A" attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
