<br />EXHIBIT A <br />Resolution No. PC-91-96 <br />Conditions or Approval <br /> <br />Case UP-91-77 <br /> <br />1. The location and operation of the proposed use shall conform <br />substantially to Exhibit A (the site plan, floor plan, and <br />details of operation), dated "Received November 7, 1991"), on <br />file with the Planning Department, except as modified by these <br />conditions. <br /> <br />2. The operation of the bar shall be limited to 10:00 a.m. to <br />2:00 a.m., seven days a week. In the event that the applicant <br />proposes to modify the hours or other aspects of operation, <br />the modification shall be subject to the review of the <br />Planning Director. The Planning Director may approve the <br />modification or refer the matter to the Planning Commission if <br />judged to be substantial. <br /> <br />3 . The applicant shall maintain the area surrounding the bar <br />tenant spaces and parking lot in a clean and orderly manner at <br />all times. The applicant shall regularly patrol outside areas <br />to ensure peace and quiet. In the event that nuisances are <br />created through the operation of the bar, either within the <br />bar itself or by its patrons in the vicinity of the bar, the <br />Planning Director may refer this conditional use permit to the <br />Planning Commission for their subsequent review at a public <br />hearing. If necessary, the Commission may modify or add <br />conditions of approval to mitigate such impacts, or may revoke <br />said conditional use permit. <br /> <br />4. If operation of this use results in conflicts pertaining to <br />parking, noise, traffic, or other factors, at the discretion <br />on the Planning Director, this conditional use permit may be <br />submitted to the Planning commission for their subsequent <br />review at a public hearing. If necessary, the Commission may <br />modify or add conditions of approval to mitigate such impacts, <br />or may revoke said conditional use permit. <br /> <br />5. The applicant shall obtain all applicable City permits for the <br />use prior to the commencement of operation. <br /> <br />6. No alcohol shall be consumed outside the establishment. <br /> <br />7. Outdoor trash dumping shall not occur between the hours of <br />10:00 p.m. and 6:00 a.m., unless it is found by the Planning <br />Director that the sound levels from dumping trash are less <br />than 60 dBA. <br />
