The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed bar and its ancillary uses will be <br />contained completely wi thin the building. The <br />project, as conditioned, requires these uses to be <br />operated in a non-nuisance manner. Suff icient <br />parking, traffic capacity and distance from <br />residential neighborhoods have been provided. <br />Although the business would be open during the day, <br />the maximum use would occur during the nighttime. <br />The business is located in an area where nighttime <br />uses would not create a nuisance to adjoining <br />areas. streets leading to the site are designed <br />per City standards and are signalized to provide <br />safe access into and out of the site. The <br />conditions of approval of the use permit, as well <br />as the applicant's design of the tenant space the <br />use will occupy, will ensure that the establishment <br />remains within the standards of all applicable City <br />codes. <br /> <br />C. <br /> <br />The proposed conditional use will <br />of the applicable provisions <br />ordinance. <br /> <br />comply with each <br />of the zoning <br /> <br />The site's PUD zoning conditionally permits the <br />establishment of bars, as defined by Municipal Code <br />section 18.08.028.
