<br />EXHIBIT A <br />Resolution No. PC-91-86 <br />Conditions or Approval <br /> <br />Case UP-91-62 <br /> <br />1. The location and operation of the proposed use shall conform <br />substantially to Exhibit A (the site plan, floor plan, and <br />details of operation), dated "Received September 27, 1991"), <br />on file with the Planning Department, except as modified by <br />these conditions. <br /> <br />2. The operation of the bar shall cease by midnight, Sunday <br />through Thursday, and 1:00 a.m., Friday and Saturday. In the <br />event that the applicant proposes to modify the hours or other <br />aspects of operation, the modification shall be subject to the <br />review of the Planning Director. The Planning Director may <br />approve the modification or refer the matter to the Planning <br />Commission if judged to be substantial. <br /> <br />3. The applicant shall maintain the area surrounding the bar <br />tenant space in a clean and orderly manner at all times. In <br />the event that nuisances are created through the operation of <br />the bar, either within the bar itself or by its patrons in the <br />vicinity of the bar, the Planning Director may refer this <br />conditional use permit to the Planning commission for their <br />subsequent review at a public hearing. If necessary, the <br />Commission may modify or add conditions of approval to <br />mitigate such impacts, or may revoke said conditional use <br />permit. <br /> <br />4. If operation of this use results in conflicts pertaining to <br />parking, noise, traffic, or other factors, at the discretion <br />on the Planning Director, this conditional use permit may be <br />submitted to the Planning Commission for their subsequent <br />review at a public hearing. If necessary, the Commission may <br />modify or add conditions of approval to mitigate such impacts, <br />or may revoke said conditional use permit. <br /> <br />5. The kitchen shall remain open, with food items available to <br />patrons, until the closing of the business. <br /> <br />6. The applicant shall obtain all applicable City permits for the <br />use prior to the commencement of operation. <br /> <br />7. Approval of this use permit shall be contingent upon approval <br />of PUD-80-2-6D-2M. <br /> <br />8. No alcohol shall be consumed within the outdoor dining areas <br />until the dining areas have been completely separated from <br />general public access consistent with the approved City <br />Council and building permit plans for this restaurant. until <br />this is accomplished, the applicants shall post signage, <br />satisfactory to the Planning Director, inside and outside of <br />the establishment giving patrons notice that the consumption <br />of alcoholic beverages within the outdoor dining areas is <br />prohibited. <br />
