The use permit for the game arcade is, <br />therefore, in accordance with the objectives of the <br />zoning district. <br /> <br />B. The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the pUblic <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />Given the proposed hours of operation and <br />separation of the arcade use from adjacent tenants, <br />staff feels the game arcade will not impact <br />surrounding uses. Also, the proposed use has <br />adequate parking to meet project demand. The <br />proposed use will not subject surrounding uses to <br />heavy truck traffic, hazardous odors, or other <br />objectionable influences. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of this chapter. <br /> <br />The site's PUD zoning conditionally permits the <br />establishment of game arcades, as defined by <br />Municipal Code section l8.08.ll0. The proposed use <br />complies with all relevant sections of the zoning <br />ordinance. Granting a conditional use permit to <br />Fremont Zones, Inc. is consistent with the City'S <br />ability to regulate zoning as listed in the <br />Municipal Code Chapter l8.l24. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act; <br />and <br /> <br />WHEREAS, As conditioned, the proposed use will be compatible with <br />the surrounding uses and properties. Condi tions of <br />approval have been included which will ensure that the <br />safety and general welfare of the surrounding area is <br />maintained. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />section 1. Approves Case UP-9l-6l, the application of Fremont <br />Zones, Inc./Discovery Zone has applied for a conditional <br />use permit to allow the installation of ten coin operated <br />eye/hand coordination games for a children's fitness/play <br />center (Discovery Zone) within an existing building <br />located at 4226 Rosewood Drive (Rose Pavilion Shopping <br />Center), subject to the conditions shown on Exhibit "A" <br />attached hereto and made part of this case by reference. <br />
