The proposed location of the conditional use and <br />the conditions under which it would be operated or <br />maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious <br />to the properties or improvements in the vicinity. <br /> <br />The proposed business will not have an adverse <br />impact on surrounding properties or tenants due to <br />its small scale of use and performance standards <br />included as conditions of approval. Also, the <br />proposed use has adequate parking to meet project <br />demand. The proposed use will not subject <br />surrounding uses to heavy truck traffic, hazardous <br />odors, or other objectionable influences. <br /> <br />C. The proposed conditional use will comply with each <br />of the applicable provisions of the Municipal Code <br />which apply to Conditional Uses. <br /> <br />As conditioned, the proposed use will comply with <br />all provisions and requirements of the City's <br />zoning ordinance. Granting a condi tional use <br />permit to Futurekids is consistent with the city's <br />ability to regulate zoning as listed in the <br />Municipal Code Chapter l8.l24. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the <br />requirements of the California Environmental Quality Act <br />(CEQA)i and <br /> <br />WHEREAS, as conditioned, the proposed use will be compatible with <br />the surrounding businesses and will not detrimentally <br />affect the surrounding uses or properties. Conditions of <br />approval have been included which will ensure that the <br />safety and general welfare of the surrounding tenants and <br />properties are maintained. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. Approves Case UP-9l-60, the application of <br />Futurekids/Glenna Bayer for a conditional use permit to <br />allow a computer instruction facility for children to be <br />located at l020 Serpentine Lane, Suite 110 in Valley <br />Business Park, subject to the conditions shown on Exhibit <br />"A" attached hereto and made part of this case by <br />reference. <br /> <br />Resolution No. PC-91-80 <br />November l3, 1991 <br />
