Section 4 GENERAL CONDITIONS 4-01. DEFINITIONS Wherever in these Specifications and other Contract Documents the following terms or pronouns in place of them are used, the intent and meaning shall be interpreted as follows: CONTRACT DOCUMENTS The Notice to Contractors, Information for Contractors, Proposal Form, Agreement, Contractor's Bond, General Conditions, and Special Conditions are hereby incorporated by reference. CONTRACTOR The person, firm, partnership, or corporation to whom this Contract is awarded by Owner and who is subject to the terms thereof. DIRECTOR OF PUBLIC WORKS The Director of Public Works for the City of Pleasanton, or successor exercising the responsibilities of the Director of Public Works, and the representative of the Director of Public Works, duly authorized and appointed by the Director of Public Works. ENGINEER The City Engineer of Pleasanton, or successor titles exercising the responsibilities of City Engineer, and the representative of the City Engineer duly authorize and appointed by the City Engineer. In the event Owner has hired any person or corporation as an independent Contractor to act in lieu of the City Engineer, the term "Engineer" shall be deemed to include such person or corporation. E. GOVERNING BODY OF THE OWNER The City Council of the City of Pleasanton. INSPECTOR The Inspector employed by the Owner to perform inspection during construction of the work, under direction of the Director of Public Works. G. OWNER The City ofPleasanton, a municipal corporation in the State of California. H. PROJECT The entire service to be performed by the Contractor pursuant to the Contract Documents. SUBCONTRACTOR A person, finn, partnership, or corporation having a direct contract with Contractor and not with Owner, for the performing of work or labor or the rendering of service to Contractor for the work.
